1. Approve the enclosed Rules of maintaining the state register of electronic information resources and information systems and depositary.

2. (Sarsenov S. S.) to provide to committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction of the copy of the order on official publication in periodic printing editions and in information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the vice-minister of investments and development of the Republic of Kazakhstan Zhumagaliyev A. K.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the state register of electronic information resources and information systems and depositary

1. General provisions

1. These rules of maintaining the state register of electronic information resources and information systems and depositary (further - Rules) are developed according to subitem 5-1) of article 6 of the Law of the Republic of Kazakhstan of January 11, 2007 "About informatization" (further - the Law).

Rules determine procedure for maintaining the state register of electronic information resources and information systems (further - the state register) and depositary of information systems, software products, program codes and the specifications and technical documentation (further - depositary).

2. Maintaining depositary is performed for the purpose of creation of single system of accounting, ensuring replacement of the acquired software product in case of its loss by the owner or owner, informing users on software products and their developers, and also information support of state bodies.

3. Maintaining the State register is provided with authorized body in the field of informatization (further - authorized body) and performed by the public technical service.

4. Maintaining depositary is provided with authorized body and performed by the public technical service.

5. The public technical service provides the organization of specifications for access of physical persons and legal entities to public state electronic information resources for the purpose of satisfaction of their information needs.

6. The public technical service cannot change and transfer to the third parties the software products, program codes and the specifications and technical documentation stored in depositary.

2. Procedure for maintaining the State register

7. Maintaining the State register includes entering of data on electronic information resources and information systems into the State register with the subsequent updating of these data.

8. The electronic information resources and information systems developed and created at the expense of private non-state means are registered in the State register at the initiative of owners of these information resources and information systems. Updating (updating) of data on non-state electronic information resources and information systems is made at the initiative of owners of the specified electronic information resources and information systems.

9. The owner or the owner of the registered electronic information resources and information systems annually, no later than March 30, represent to authorized body the message on updating of electronic information resources and information systems with the complete updated description of electronic information resources and information systems or about lack of updates, or about the termination of their operation with motivated statement of the reasons of the termination of operation in form according to Appendix to these rules. The authorized body sends information on updates and (or) the termination to the public technical service.

10. Entering of updated data on electronic information resources and information systems into the State register is performed according to the procedure and terms which are established for registration of electronic information resources and information systems.

11. In case of non-presentation at the scheduled time of the updated request or the message on the termination of operation of electronic information resource or information system the authorized body sends he (she) to the owner or the owner the corresponding official request for need of updating of data.

12. In case of receipt of the message on the termination of operation of electronic information resource or information system the authorized body within five working days performs withdrawal of the registration certificate of this electronic information resource or information system, and the public technical service in ten-day time provides entering of corresponding changes into the State register.

13. Data of the State register on electronic information resources and information systems in the part which is not containing electronic information resources of limited access are public on posted online the "state register of electronic information resources and information systems of the Republic of Kazakhstan" Internet resource.

14. The state information resources and the state information systems are subject to obligatory accounting in the state register of electronic information resources and information systems.
