About approval of the Rules determining criteria of reference of dikes to declared, and Rules of development of the declaration of safety of dike

According to subitem 19-1) of article 36 of the Water code of the Republic of Kazakhstan of July 9, 2003 the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) the Rules determining criteria of reference of dikes by declared;

2) Rules of development of the declaration of safety of dike.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

The rules determining criteria of reference of dikes by declared

1. The these rules determining criteria of reference of dikes to declared (further - Rules), are developed according to subitem 19-1) of article 36 of the Water code of the Republic of Kazakhstan of July 9, 2003 and extend to the organizations irrespective of patterns of ownership operating the dikes (further - the organizations) which are subject to obligatory declaring in the field of safety of dikes.

2. The basic concepts used in these rules:

dike - the retaining hydraulic engineering construction on waterway for rise in water level and (or) creation of water storage basin;

dike class - the high-quality quantity characteristic regulated by existing rules of designing determining degree of the social and economic importance and responsibility of the hydraulic engineering construction and appointed taking into account effects of its accident and/or breakdown of service;

hydrodynamic accident - the accident on the hydraulic engineering construction connected with distribution with the high speed of water and creating threat of emergence of technogenic emergency situation;

the pressure head front - set of the water retaining constructions perceiving pressure (water pressure).

3. Dikes depending on their height, type of soil of the basis, amount, social and economic responsibility and effects of possible hydrodynamic accidents subdivide into 4 classes:

The I class - dikes of extremely high danger;

The II class - dikes of high danger;

III class - dikes of average danger;

The IV class - dikes of low danger.

4. The main criterion of reference of dikes to declared is their class determined according to appendix to these rules.

5. Dikes of I, II, III classes irrespective of forms of their property are subject to declaring.

6. The dikes of the IV class constituting the increased danger in case of emergency situations according to the conclusion of the project organization are also subject to declaring.

7. The class of dikes is established by the project organization by preparation of the project documentation and can be changed at stages of construction, capital repairs, commissioning, operation, reconstruction, recovery and preservation in the presence of reasonable changes of parameters of dike and (or) conditions of its operation.

8. The class of the main constructions which are part of the pressure head front of dike shall be established on the construction carried to higher class.

9. In case of change of the conditions determining dike class it shall be brought into accord with the changed conditions with obligatory specifying in the declaration.
