Regulations on the single organizer of procedures of public procurements in spheres of informatization, information and communication technologies and telecommunications

1. This Provision determines tasks and functions of the Ministry of Communications and Informatization acting as the single organizer of procedures of public procurements of goods (works, services) in spheres of informatization, information and communication technologies and telecommunications (further, unless otherwise specified, - the single organizer), establishes order of interaction of customers of actions of state programs of informatization and their subprogrammes (further, respectively, - the customer, programs of informatization) with the single organizer.

2. In this Provision terms in the values determined by the Law of the Republic of Belarus of July 13, 2012 No. 419-Z "About public procurements of goods (works, services)", the Presidential decree of the Republic of Belarus of December 22, 2014 No. 612 and the resolution of Council of Ministers of the Republic of Belarus of May 22, 2015 No. 431 "About procedure for functioning of single system state scientific and state scientific and technical examinations are used".

3. The single organizer performs general coordination of carrying out public procurements of goods (works, services) in spheres of informatization, information and communication technologies and telecommunications (further - public procurement), provides development of single policy and determination of uniform approach to their carrying out, and also performs other functions and tasks provided by legal acts.

4. For the purpose of implementation of public procurement customers provide to the single organizer the stipulated by the legislation specifications approved by them (further - the specification).

5. The specification is subject to registration in day of its receipt in the Ministry of Communications and Informatization.

6. The single organizer within two working days after receipt of the specification in accordance with the established procedure sends it to the State committee on science and technologies for conducting the state scientific and technical examination.

7. For carrying out public procurement customers provide to the single organizer on paper and in electronic form:

the copy of the specification according to which the positive decision of the state scientific and technical examination is received;

the documents submitted to participants for preparation of offers on participation in the procedure of public procurement for actions of programs of informatization;

copy of the decision of the customer on holding procedure of public procurement;

reasons for the choice of type of the procedure of public procurement;

the results of studying of market situation containing, including the data necessary for holding such procedure, according to the legislation on public procurements;

the statement from the annual plan of public procurements of the customer with indication of the planned procedure of public procurement;

offers on candidates from number of persons employed of the customer in structure of the commission created by the single organizer for the organization and holding procedure of public procurement;

the draft of the help about holding procurement procedure from one source (when holding procurement procedure from one source);

other documents, stipulated by the legislation about public procurements.

8. Based on the specification according to which the positive decision of the state scientific and technical examination, the single organizer is received:

8.1. carries out:

open tender (including in the form of two-stage tender and tender with limited participation);

closed competition;

electronic auction;

the procedure of request of price offers in case of the threshold value of estimated cost of goods (works, services) determined according to the legislation;

procurement procedure from one source;

8.2. according to the procedure, established by the legislation on public procurements, creates the commission for the organization and holding procedure of public procurement. At the same time the structure of the commission created for the organization and holding procedure of public procurement joins representatives of customers;

8.3. registers no later than the next working day from the date of receipt from the customer the documents specified in Item 7 of this provision;

8.4. within ten working days from the date of registration considers the documents submitted to participants for preparation of offers on participation in procedures of public procurements and other documents which arrived from the customer for further approval by the customer or sends it offers on their completion for the purpose of reduction to compliance with the legislation on public procurements.

The customer within three working days after receipt of the relevant proposal of the single organizer makes the decision on completion or document approval and submits to the single organizer modifed documents repeatedly for review, and the approved documents for placement on electronic trading platform.

The documents approved for holding procedure of public procurement by the customer are submitted to the single organizer in day of their approval and are placed on electronic trading platform the single organizer no later than one working day following behind day of adoption of such decision;
