1. Approve the enclosed Rules of issue of permissions to production of explosive works.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (to Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction of the copy on official publication in mass media and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the vice-minister of investments and development of the Republic of Kazakhstan Rau A. P.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of issue of permissions to production of explosive works

Chapter 1. General provisions

1. These rules of issue of permissions to production of explosive works (further - Rules) are developed according to the subitem 111) of Item 16 of the Regulations on the Ministry of Emergency Situations of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 23, 2020 No. 701 and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law) and determine procedure for issue of permissions to production of explosive works, and procedure for rendering the state service "Issue of Permissions to Production of Explosive Works".

2. Action of these rules extends to explosives and products on their basis for use in the industrial purposes.

3. Action of these rules does not extend to the explosives and products on their basis relating to defense and civil products.

4. The state service "Issue of Permissions to Production of Explosive Works" (further - the state service) appears territorial departments of Committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan (further - the service provider) according to these rules.

5. In these rules the following basic concepts are used:

1) the standard of the state service – the list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service;

2) permission – confirmation of the right of physical person or legal entity to the implementation of activities or actions (transactions) performed by allowing bodies by means of licensing or the allowing procedure;

3) explosive – the condensed chemical or mix of such substances capable under certain conditions under the influence of external impacts to the bystry self-extending chemical transformation (explosion) with allocation of large amount of heat and gaseous products;

Chapter 2. Procedure for rendering the state service

6. For receipt of the state service legal entities (further - uslugopoluchatel) send to the service provider through the web portal of "the electronic government" www.egov.kz (further - the portal):

1) the statement in electronic form, the uslugopoluchatel certified by the digital signature, in form according to appendix 1 to these rules;

2) the electronic document containing the data with indication of calculations specifying conditions of safe accomplishment of explosive works, safe distances on scattering of pieces, action of shock air wave, effect of poisonous gases in case of explosion, seismic impact;

3) when carrying out explosive works:

on the land surface, the electronic document the containing site plan with drawing production site of explosive works, borders of the danger area, place of exposure of posts of protection of the danger area and the residential and factory buildings which are in its limits, constructions, railway tracks, highways, channels, pipelines, power lines;

in underground conditions, the electronic document the containing plan of mining operations with drawing production site of explosive works, borders of the danger area, place of exposure of posts of protection of the danger area, and also data on danger of the mine (the mine, object of exploration works) on gas and dust.

When carrying out seismoprospecting works with use of explosive materials the electronic document containing schemes of profiles of works and protection of the danger area is provided.
