1. Approve the enclosed Rules of issue of the certificate on the right of temporary export of cultural values.

2. For culture and art of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation to provide to department:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan after its official publication;

4) submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of the actions provided by this Item within ten working days from the date of execution of actions.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Issue of the Certificate on the Right of Temporary Export of Cultural Values"

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of the Certificate on the Right of Temporary Export of Cultural Values" (further – Rules) determine procedure for rendering the state service "Issue of the Certificate on the Right of Temporary Export of Cultural Values" (further – the state service) and are developed according to subitem 23-1) of article 7 of the Law of the Republic of Kazakhstan of December 15, 2006 "About culture" (further – the Law "About Culture") and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further – the Law "About the State Services").

The state service appears local executive bodies of areas, Nour-Sultan's cities, Almaty and Shymkent (further – the service provider) to physical persons and legal entities (further – uslugopoluchatel) for the term of no more than six months for the purpose of temporary exhibiting, tour activities, restoration works and scientific research, the presentations, exhibitions and holding the international cultural actions.

Chapter 2. Procedure for rendering the state service

For receipt of the state service uslugopoluchatel send to the service provider through web portals of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal) the application signed by the digital signature (further – the EDS) in form according to appendix 1 to these rules with application of documents (further – the statement), specified in Item 8 of the Standard of the state service "Issue of the Certificate on the Right of Temporary Export of Cultural Values" (further – the Standard) according to appendix of 2 these rules.

In case of factual determination of incompleteness of the submitted documents, the service provider within the specified term gives motivated refusal in further review of the statement.

Data on identity documents of uslugopoluchatel, on state registration (re-registration) as the legal entity, about state registration as the individual entrepreneur, being the state electronic information resources, the service provider receives from the corresponding state information systems through lock of "the electronic government".

7. In case of completeness of the submitted documents provided in Item 8 of the Standard, the executive in charge notifies in "personal account" of uslugopoluchatel on need of provision of subject for consideration by the commission of experts of temporary export of cultural values created according to the subitem 6) of article 8 of the Law "About Culture" (further – the commission).

8. After the notification the uslugopoluchatel within 1 (one) working day provides subject to the service provider.

9. The provided subject in day of receipt to the service provider goes his executive in charge to the commission for conducting examination.

10. The commission carries out expertize of subject within 1 (one) working day by the comprehensive analysis with determination of historical, art, scientific or other cultural value, authenticity, authorship, the name, the place and time of creation, material and technology of execution, and also the description of the sizes (weight), distinctive features, safety conditions.
