1. Approve the enclosed Rules of supply of oil products as the single operator on supply of oil products.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in mass media and information system of law of Ad_let;

3) publication of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the First vice-Minister of Energy of the Republic of Kazakhstan Karabalin U. S.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of supply of oil products by the single operator on supply of oil products

Chapter 1. General provisions

1. These rules of supply of oil products by the single operator on supply of oil products (further - Rules) are developed according to subitem 21-1) of article 7 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products".

2. Rules determine procedure for the organization and supply activity of oil products by the single operator by supply of oil products.

3. In Rules the following terms and determinations are applied:

1) partners - The armed Forces of the Republic of Kazakhstan, the Border service of Committee of homeland security of the Republic of Kazakhstan, National guard of the Republic of Kazakhstan, authorized body in the field of civil protection, authorized body in the field of the state material reserve acquiring oil products at the single operator for own needs;

2) oil products - separate types of oil products: gasoline, aviation and diesel fuel, fuel oil, road bitumen;

3) the single operator on supply of oil products (the single operator) - the legal entity determined by authorized body in the field of production of oil products which main object of activity is providing Armed Forces of the Republic of Kazakhstan, the Border service of Committee of homeland security of the Republic of Kazakhstan, National guard of the Republic of Kazakhstan, authorized body in the field of civil protection, authorized body in the field of the state material reserve with oil products, and also provision by it of services in storage and delivery of oil products;

4) the request - the written address of the partner about shipment of oil products under the agreement with the single operator represented to the single operator with indication of quantity, types of oil products, the place, terms and other conditions of supply of oil products;

5) gas station – the technology complex and the equipment providing the storage and retail sale of oil products equipped with survey meters of accounting;

Gas stations are subdivided into the following types:

stationary – with underground or land placement of reservoirs, intended for filling with oil products of vehicles through fuel-dispensing columns;

container – with land arrangement of reservoirs for storage of oil products which technology system is characterized by placement of fuel-dispensing columns in the container of storage of oil products executed as single factory product;

portable – with placement of reservoir and fuel-dispensing column on the automobile chassis, trail car, semitrailer truck executed as single factory product;

6) the coupon - the control document of the strict reporting having identification characteristics: series, number, watermark, the having certain effective period during which the partner provides acceptance of oil products and in case of which presentation the single operator transfers to the partner oil product at gas station in the quantity and the name specified in this document;

7) the owner of the coupon - the worker (employee) of the partner or other person authorized by the partner to whom the coupon was transferred by the partner;

8) the fuel card - the plastic card representing the personified technical tool of accounting of transfer of oil products at gas station with the built-in electronic chip containing information on the enlisted amount of oil products within which the owner of the fuel card has the right to receive oil product at gas station;

9) the owner of the fuel card - the worker (employee) of the partner or other person authorized by the partner to whom the fuel card was transferred by the partner;

10) crisis situation - set of conditions and circumstances in the state or in its certain territory in case of which the operating system of measures of preventions and neutralizations of threats of homeland security becomes insufficient for providing life and health of the population, maintenance of public order, internal political stability and protection of bases of the constitutional system;

11) the airport - the complex of constructions intended for acceptance and sending aircrafts, servicing of airborne transportations and having airfield, air terminal, other necessary constructions and the equipment for these purposes;
