The agreement between the Ministry of Agriculture, Water Resources and Processing Industry of the Kyrgyz Republic and the Ministry of agrarian policy of Ukraine on cooperation in the field of testing and protection of plant varieties

of March 28, 2003

The Ministry of Agriculture, Water Resources and Processing Industry of the Kyrgyz Republic and the Ministry of agrarian policy of Ukraine which are referred to as as "Contracting parties",

aiming at development of bilateral cooperation in the field of testing and protection of plant varieties, to trade improvement, exchange of genetic material and high-quality resources,

agreed as follows:

Article 1

Contracting parties support, implement and constantly develop bilateral cooperation in the field of testing and protection of plant varieties.

Article 2

The cooperation between Contracting Parties within this agreement will be performed according to the legislation of their states.

Competent authorities of Contracting Parties perform direct connection for the purpose of execution of this agreement and have the right to sign mutual agreements.

Article 3

For the purpose of stable cooperation in the field of testing and protection of plant varieties Contracting Parties shall recognize mutually results of testing of the plant varieties for compliance to protectability conditions (distinguishability, uniformity, stability) which are carried out by Competent Authorities of Contracting Parties and by agreement to exchange them.

Article 4

Competent authorities of Contracting Parties annually till December 1 of the current year approve the program of cooperation the next year.

Article 5

Competent authorities of Contracting Parties perform:

- exchange of information and technical documentation in the field of testing and protection of plant varieties;

- joint development of techniques of testing of plant varieties for compliance to protectability conditions (distinguishability, uniformity, stability) and their economic value;

- development of laboratory and field trials on high-quality identification, economic value;

- educational training and training of specialists by their sending from one country to another for the purpose of studying of techniques and results of testing of plant varieties, and also exchange and acquisition of practical experience in this area in accordance with the terms hereof;

- rendering mutual aid in scientific and technical activities within the competence.

Article 6

Exchange of delegations of specialists and selectors is performed on the terms of equivalent exchange in the amounts approved by Contracting Parties. The party sending the specialist or the selector pays its transportation expenses, including insurance, to the destination and back and the established traveling daily allowance corresponding in this country.

The host party pays expenses for accommodation and trips in the state according to the program of stay.

Article 7

Contracting Parties charge coordination of works on implementation of this agreement to the joint Working group which will consider projects and programs of cooperation, to prepare offers for the interested governmental bodies about procedure for their implementation, and also to approve development and execution of joint actions for cooperation which are performed according to this agreement.

The working group will hold the meetings according to the mutual arrangement serially in the Kyrgyz Republic and in Ukraine once a year.

Meetings of the Working group are drawn up by the protocol.

Article 8

For discussion and decision making on scientific and practical questions of testing and protection of plant varieties Competent Authorities of Contracting Parties can convoke and hold by agreement the corresponding joint meetings and seminars.

Such meetings or seminars are held serially in the Kyrgyz Republic and Ukraine. Time and the venue of meeting is determined by the mutual arrangement.

Article 9

Each of Contracting Parties not publish the economic, industrial and scientific and technical information obtained from other Contracting Party and also results of joint operations unless on it the prior written consent of this Contracting Party is received.

Results economic and sci-tech cooperation can independently be used if another is not caused by Contracting Parties.

About the property right and use of the results received during joint operations, Contracting Parties agree in separate protocols.

Article 10

Competent authorities which on behalf of Contracting Parties bear responsibility and perform coordination of execution of this agreement, are:

- from the Kyrgyz Side - State commission of the Kyrgyz Republic on strain testing;

- from the Ukrainian Side - Public service on protection of the rights to plant varieties.

Article 11

The agreement becomes effective from the moment of its signing.

This agreement is signed for a period of 5 years. Its action will be prolonged automatically the next 5 years if one of Contracting Parties no later than in six-months time before the end of action of this agreement in writing does not notify other Contracting Party on its denouncement.

It is made to Kiev on March 28, 2003 in duplicate, everyone in the Kyrgyz, Ukrainian and Russian languages, at the same time all texts are authentic.

In case of disagreements in interpretation of provisions of this agreement, the Parties will be guided by the text in Russian.
