1. Approve the enclosed Rules of carrying out survey of places of cabins on sites of the state forest fund.

2. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic Kaakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out survey of places of cabins on sites of the state forest fund

1. These rules of carrying out survey of places of cabins on sites of the state forest fund (further - Rules) are developed according to subitem 18-29) of Item 1 of Article 13 of the Forest code of the Republic of Kazakhstan of July 8, 2003 and determine procedure for carrying out survey of places of cabins on sites of the state forest fund.

2. The state forest owners (further - forest owners) after completion of works on wood procurement, for the purpose of detection of completeness and correctness of development of cutting areas, and also identification of the remained nedorub (pererub), not exported wood and the hanged trees when implementing procurement of wood carry out survey of places of cabins on sites of the state forest fund.

3. All places of cabins where the term of procurement and removal specified in allowing documents (logging tickets) ended are subject to survey.

By provision of delays on removal of wood after the term of delays repeated survey is carried out.

4. Survey of places of cabins is made within 30 calendar days from the date of the termination of effective period of the logging ticket, and in case of the end of procurement and removal of wood before the term specified in the logging ticket from the date of the notification.

5. The forest owner in writing informs the forest user or his representative on day of survey of places of cabins not later than 5 calendar days to the appointed term.

In case of absence of the forest user or his representative to the appointed term the forest owner carries out survey without its participation. At the same time the drawn-up statement of survey of places of cabins (further - the act) in form, according to appendix to these rules, is sent to the forest user within 10 calendar days after creation of the act.

6. For the purpose of control of observance of requirements of technology of development of cutting areas (preserving undergrowth, cleaning of cutting areas) survey is carried out to the snowless period. In case of adverse climatic conditions (considerable snow cover, flood of the rivers, impassability of roads) survey is postponed to other time determined by forest owner in coordination with the forest user.

7. When carrying out survey of places of cabins the forest owner has in case of itself:

1) allowing documents (logging tickets) or their copies and outlines on everyone which are subject to survey cutting area (allotment) with indication of places of warehousing of wood;

2) measuring devices and tools (goniometric tool, measuring tape, roulette, measuring fork);

3) materials on branch and valuation of cutting areas (the sheet recouple of trees, the sheet of material money value of cutting areas, the act of preliminary transfer of felling fund);

4) forms of acts of survey, protocols on administrative offenses, reeven sheets, material money value.

8. The forest user participating in survey has in case of himself:

1) if legal entity:

on the forest user's representative - the power of attorney;

the certificate of amount of the prepared wood in any form (including business, wood, liquid brushwood and boughs), signed by the head of the organization and the chief accountant;

the drawn-up process chart;

2) if physical person:

the certificate of amount of the prepared wood (including business, wood, liquid brushwood and boughs) signed by the individual entrepreneur;

the drawn-up process chart.

9. Results of survey of places of cabins are entered in the act signed by representatives of forest owner, the forest user and all persons (the master of the wood, the forester) participating in survey. In the act except the data obtained in case of survey also data on amount of actually prepared business and wood wood according to the reference of the forest user are entered.

10. By results of survey of places of cabins the forest owner submits in superior organization on departmental subordination the report on wood remaining balance on cutting areas and cleaning of places of cabins in form 4-LH of the Chairman of Committee approved by the order of the acting as according to the statistics the Ministry of national economy of the Republic of Kazakhstan of December 30, 2015 No. 231 "About approval of statistical forms of the departmental statistical observations and instructions for their filling developed by Committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan" (No. registered in the Register of state registration of regulatory legal acts 13573).

11. Account of results of survey of places of cabins is kept on each cutting area (allotment), data on which are entered in the logging ticket separately.

Also 50-meter strips adjacent to cutting areas are subject to survey.

12. When carrying out survey of places of cabins completeness and correctness of development of cutting areas, compliance of methods of development of cutting areas (width of cutting areas and volok, placement of loading platforms, warehouses and other auxiliary objects, observance of lesovodstvenny requirements) to the process chart and Rules of cabins of the wood on sites of the state forest fund approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of June 30, 2015 No. 18-02/596 (registered in the Register of state registration of regulatory legal acts No. 11894) are established.
