About approval of Service regulations of own goods wagons

According to article 5 of the Charter of the railroads of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of April 6, 1998 No. 457, for the purpose of improvement of the organization of operation of own goods wagons on rail transport public I order:

1. Approve Service regulations of own goods wagons which are attached.

2. To provide to public administration of rail transport of Ukraine submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

3. Declare invalid the order of the Ministry of Transport and Communications of Ukraine of September 28, 2004 No. 856 "About approval of Rules of registration and operation of own goods wagons", No. 1316/9915 registered in the Ministry of Justice of Ukraine on October 15, 2004.

4. This order becomes effective from the date of its official publication.

5. I reserve control over the implementation of this order.

Service regulations of own goods wagons

I. General provisions

1.1. These rules regulate method of operation of own goods wagons on rail transport public.

Rules are obligatory in case of carriages of goods by the cars which are in property of carriers, operators, companies, organizations, organizations, physical persons entrepreneurs who lease them from other owners or which they have based on the agreement of property management, cooperation agreement and so forth.

1.2. In these Rules terms are used in the following values:

ABD PV - the automated databank of the park of goods wagons;

cars doubles - availability on network of the railroads of several own goods wagons which have identical common network numbers with the correct control sign;

Cars of the inventory park - goods wagons of carrier which have general network numbering with sign in ABD PV "car of the inventory park" according to the operating numbering and drawing numbers on cars according to Signs and texts, and also goods wagons which are on balance of the railroads of other railway administrations of agreement parties about joint use of goods wagons and containers of property of the State Parties of the Commonwealth, the Azerbaijan Republic, the Republic Georgia, the Republic of Latvia, the Republic of Lithuania, the Republic of Estonia of March 12, 1993 (further - the Agreement);

own goods wagons - the goods wagons having the common network numbering applied on cars according to the album reference book of 632-2011 PKTB TsV "Signs and Texts on Cars of the Cargo Park of Track of 1520 Mm" approved by Council for rail transport of the State Parties of the CIS on April 25, 2001 (further - Signs and texts), also have sign in ABD PV "own car";

running prohibition - impossibility of the car to move on ways public in the empty and loaded conditions in the presence of the obstacles specified in ABD PV;

serial number - sequence number of the car of the specified model which is assigned by the car-building plant;

the common network wagon number - the eight-digit number provided by railway administration is also put aboard the car;

common network census of goods wagons - natural number census of goods wagons which is performed on all railway net of the State Parties of the Agreement;

railway tracks of general use - the ways belonging to the railroads;

infrastructure of rail transport public - the technological complex including railway tracks public, railway stations, devices of electric utility service, communication network, alarm installation, centralization and blocking, information complexes and traffic control system and buildings, constructions, devices and the equipment providing functioning of this complex;

running - movement of cars railway tracks;

the operator - independent subject of managing which based on contracts with the railroad and consignors participates in course of carriage of loads with use of own railway vehicles leased from other owner or which he owns based on joint activities, the agreement of property management and so forth;

leased own cars - own goods wagons given by the owner to use for certain term to other person or physical person entrepreneur based on the lease agreement;

carrier - the legal entity or the physical person - the entrepreneur who undertook obligations and the agreement responsibility of cargo hauling for delivery to the destination of the load entrusted it, carriage of goods and their issue (transfer) to the consignee;

rotation polygon - the area of running of cars within the road of addition the railroads of Ukraine and beyond its limits;

run of cars - actually executed scope of work of the car during interrepair time of operation;

PTO - Item of maintenance of cars;

numbering system of own goods wagons - the table of correspondences of common network numbers of own goods wagons to their characteristics and technical parameters;

SMGS - The agreement on the international railway freight traffic which Ukraine joined according to the resolution of the Cabinet of Ministers of Ukraine of April 3, 1993 No. 246 "About agreements on the international railway freight and passenger traffic";

the station of addition - the station at which own railway vehicles for sediment on the ways are attributed.

1.3. The railroads and the companies of rail transport of Ukraine provide equal conditions for access for all owners of cars, operators and carriers to use of infrastructure of rail transport public.

1.4. Concerning operation of own goods wagons which are not regulated by these Rules the international agreements of Ukraine, provision of the Charter of the railroads of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of April 6, 1998 No. 457 (further - the Charter of the railroads of Ukraine), and other regulatory legal acts are applied.

II. Numbering of own goods wagons

2.1. For identification of the car during its operation on the ways public Ukrzaliznytsya together with the owner of the car assigns common network number to own goods wagon according to numbering system of own goods wagons. Number assigned to the car cannot be provided for other cars.

2.2. Upon purchase of cars directly at the car-building company the owner of cars or the company addresses Ukrzaliznytsi with the request about allocation of common network numbers for drawing them on cars the car-building company.

2.3. After receipt of information on the selected number the owner of the car shall provide drawing it on the car according to signs and texts with provision of log book of the VU-4M form and in a month to transfer data on picking of the car.
