About implementation of the Water code of the Republic of Belarus

Based on the paragraph of the seventh of article 10 of the Law of the Republic of Belarus of November 26, 1992 No. 1982-XII "About environmental protection" and paragraphs two, third and seventh subitem 1. 3, subitems 1.4 and 1.5 of Item 1 of Article 11, of item 4 of Article 19, of Item 5 of Article 30, of Item 3 of article 58 of the Water code of the Republic of Belarus DECIDES: Council of Ministers of the Republic of Belarus

1. Approve:

The regulations on procedure for issue of permissions to special water use, introduction of changes in them and (or) amendments, prolongation of term, the termination of their action and issue of duplicates, and also issue of the conclusions about possibility of production of the amounts of underground waters declared by the water user (are applied);

The regulations on procedure for activities of basin councils (are applied);

Regulations on procedure for maintaining the state water inventory and use of its data (are applied).

Establish form of the state act on the right of the isolated water use according to appendix 1.

2. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. in item 4 of appendix to the resolution of Council of Ministers of the Republic of Belarus of January 10, 2011 No. 26 "About establishment of the list of actions for environmental protection and reproduction of the natural resources financed by means republican and local budgets" (The national register of legal acts of the Republic of Belarus, 2011, No. 7, 5/33151; National legal Internet portal of the Republic of Belarus, 12.04. 2014, 5/38687):

to state the paragraph of the sixth in the following edition:

"liquidation of the hydraulic engineering constructions and devices, including water intaking constructions thrown and not subject to further use;";

the ninth to add the paragraph with the words "and to improvement of places for the recreation, sport and tourism located in borders of these territories";

the tenth to state the paragraph in the following edition:

"plan development of management of river basins, and also water management balances for separate administrative and territorial units (areas and Minsk) in case of lack of the approved management plans river basins;";

the twelfth to state the paragraph in the following edition:

"development and (or) adjustment of projects of the water protection zones and coastal strips, and also installation of information signs of borders of the water protection zones and coastal strips;";

2.2. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022 No. 175

4. To the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk Gorispolkom according to competence to take necessary measures for implementation of this resolution.

Grant the right to the Ministry of Natural Resources and Environmental Protection to make explanations about procedure for application of the Regulations on procedure for issue of permissions to special water use, introduction of changes in them and (or) amendments, prolongation of term, the termination of their action and issue of duplicates, and also issue of the conclusions about possibility of production of the amounts of underground waters declared by the water user approved by this resolution.
