About voluntary consolidation of territorial communities

Section I General provisions

Article 1. The relations regulated by this Law

1. This Law governs the relations arising in the course of voluntary consolidation of territorial communities of villages, settlements, cities, and also voluntary accession to the integrated territorial communities.

Article 2. Principles of voluntary consolidation of territorial communities

1. Voluntary consolidation of territorial communities of villages, settlements, cities is performed with respect for the following principles:

1) constitutionality and legality;

2) voluntariness;

3) cost efficiency;

4) state support;

5) omnipresence of local self-government;

6) transparency and openness;

7) responsibility.

Article 3. Subjects of voluntary consolidation of territorial communities

1. Subjects of voluntary consolidation of territorial communities is adjacent territorial communities of villages, settlements, cities.

2. The integrated territorial community which administrative center determines the city is city territorial community which center determines the settlement, - settlement which center determines the village, - rural.

Article 4. Main conditions of voluntary consolidation of territorial communities

1. Voluntary consolidation of territorial communities of villages, settlements, cities is performed in case of observance of the following conditions:

1) as a part of the integrated territorial community there cannot be other territorial community which has the representative body of local self-government;

2) the territory of the integrated territorial community shall be indissoluble, borders of the integrated territorial community are determined by external borders of jurisdiction of councils of territorial communities which united;

3) the integrated territorial community shall be located within the territory of the Autonomous Republic of Crimea, one area;

4) in case of decision making about voluntary consolidation of territorial communities the historical, natural, ethnic, cultural and other factors influencing social and economic development of the integrated territorial community are taken into account;

5) quality and availability of public services in the integrated territorial community, cannot be lower, than before consolidation;

6) consolidation of territorial communities is performed according to perspective plans of forming of the territories of communities of the Autonomous Republic of Crimea, area;

2. The administrative center of the integrated territorial community determines the settlement (the village, the settlement, the city) which has the developed infrastructure and is, as a rule, located closer to the geographical center of the territory of the integrated territorial community.

3. Voluntary consolidation of territorial communities does not lead to change of the status of settlements as rural or city zone.

4. The name of the integrated territorial community, as a rule, is derivative of the name of the settlement (villages, the settlement, the city) determined by its administrative center.

Section II Procedure for Voluntary Consolidation of Territorial Communities

Article 5. Initiation of voluntary consolidation of territorial communities

1. Can be initiators of voluntary consolidation of territorial communities of villages, settlements, cities:

1) rural, settlement, city chairman;

2) at least a third of deputies from general structure of village, settlement, city council;

3) members of territorial community according to the procedure of local initiative;

4) bodies of self-organization of the population of the corresponding territory (on condition of representation of interests by them at least a third of members of the corresponding territorial community).

2. The offer on initiation of voluntary consolidation of territorial communities shall contain, in particular:

1) the list of the territorial communities united with indication of the respective settlements;

2) determination of the administrative center of the integrated territorial community and its name.
