According to the subitem 5) of article 15 of the Law of the Republic of Kazakhstan of November 28, 2014 "About the republican budget for 2015 - 2017" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of use of target current transfers from the republican budget for 2015 by regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population.

2. To provide to akims of areas, cities of Astana and Almaty timely and target use of budgetary funds.

3. Declare invalid the order of the Government of the Republic of Kazakhstan of February 17, 2014 No. 97 "About approval of Rules of use of target current transfers from the republican budget for 2014 - 2016 regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population" (SAPP of the Republic of Kazakhstan, 2014, No. 6, the Art. 64).

Rules of use of target current transfers from the republican budget for 2015 regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population

1. General provisions

1. These rules of use of target current transfers from the republican budget for 2015 are developed by regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population (further - Rules) according to the subitem 5) of article 15 of the Law of the Republic of Kazakhstan of November 28, 2014 "About the republican budget for 2015 - 2017".

2. Rules determine procedure for use of target current transfers from the republican budget regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population provided by the budget for the republican budget program 043 "Target current transfers to regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population", except for the following subprogrammes:

1) 100 "Introduction of standards of special social services";

2) 101 "Placement of the state social order in the non-governmental sector".

3. Use of target current transfers is performed according to the Budget code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About public procurements".

4. In these rules the following concepts are used:

1) special social services - range of services, to providing person (family) which is in difficult life situation, conditions for overcoming the arisen social problems and opportunities of participation in life of society, equal with other citizens, directed to creation to them;

2) assistants - persons involved by department of employment and social programs on contractual basis for carrying out consultations, interviews with the applicant who addressed the akim of the settlement, village, rural district (further - the akim of the rural district) for receipt of the caused monetary assistance, escort of person (family) during implementation of the social contract of activization of family, monitoring and creation of the report on the done work;

3) consultants for social work - persons involved by department of employment and social programs on contractual basis for carrying out consultations, interviews with the applicant who addressed to the department of employment and social programs for receipt of the caused monetary assistance, escort of person (family) during implementation of the social contract of activization of family, carrying out monitoring and creation of the report on the done work interacting with specialists of bodies and organizations of social protection of the population, agricultural industry and other organizations;

4) the social contract - the agreement between physical person from among the unemployed, independently busy and needy citizens of the Republic of Kazakhstan participating in the state measures of assistance of employment, and employment center determining the rights and obligations of the Parties;

5) the average per capita income - the share of comprehensive income of family falling on each family member in month;

6) date of the address - month of filing of application behind purpose of the caused monetary assistance in authorized body or to the akim of the rural district with all necessary documents;

7) the government address public assistance (further - the address public assistance) - the payment in cash provided by the state to physical persons (families) with the monthly average per capita income below the poverty line, established in areas, the city of republican value, the capital;

8) authorized body of area - the management of coordination of employment and social programs of local executive body of area performing coordination of project implementation of Orleu and its monitoring;

9) the individual plan of the help to family (further - the individual plan) - complex of the actions for assistance of employment and (or) social adaptation developed by authorized body together with the applicant;

10) the social contract of activization of family - the agreement between the able-bodied physical person acting on behalf of family for participation in the Orleu project, and authorized body, determining the rights and obligations of the Parties;

11) comprehensive income of family - the total amount of income gained as in cash, and natural form, in 3 months preceding month of the request for purpose of the caused monetary assistance calculated according to the Rules of calculation of comprehensive income of person (family) applying for receipt of the government address public assistance, approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of July 28, 2009 No. 237-p (No. 5757) is registered in the Ministry of Justice of the Republic of Kazakhstan on August 28, 2009;

12) the Orleu project - the program of provision of the caused monetary assistance to family (person) on condition of participation of able-bodied family members (person) in the state measures of assistance of employment and passing, in case of need social adaptation of family members (person), including able-bodied;

13) the applicant - person who submitted the application from himself and on behalf of family on participation in the Orleu project;

14) the administrator of the republican budget program - the central authorized body in the field of health care and social development performing financing of measures for rendering the public assistance to separate categories of citizens and monitoring of their realization;

15) authorized body - the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city, the cities of district value performing purpose of the caused monetary assistance, development, the conclusion and support of the social contract of activization of family;

16) the precinct election commission - the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of persons (families) which asked for the address public assistance;

17) the applicant - person addressing from himself and on behalf of family for participation in the Orleu project;

18) the caused monetary assistance (further - ODP) - the payment in cash provided by the state to physical persons or families with the monthly average per capita income is lower than 60 percent from the size of subsistence minimum on the terms of the social contract of activization of family.

5. Target current transfers to regional budgets, budgets of the cities of Astana and Almaty on rendering social protection and the help to the population are used according to the following budget subprogrammes:

1) 103 "Implementation of the Actions plan on providing the rights and improvement of quality of life of disabled people" (further - the subprogramme 103);

2) 104 "Implementation of the caused monetary assistance on Orleu's project" (further - the subprogramme 104);

3) 105 of "Service in replacement and setup of speech processors to cochlear implants" (further - the subprogramme 105).

6. The administrator of the republican budget program makes transfer of target current transfers to regional budgets, budgets of the cities of Astana and Almaty based on individual funding plan of the budget program 043 and subprogrammes 103, 104 and 105 on payments, approved in accordance with the established procedure.

2. Procedure for use of target current transfers from the republican budget for 2015 regional budgets of Akmola, East Kazakhstan and Jambyl regions on implementation of the caused monetary assistance (further - ODP) on the Orleu project

7. Target current transfers to budgets of Akmola, East Kazakhstan and Jambyl regions on implementation of ODP on the Orleu project are used on:

1) payment of ODP;

2) fee of consultants for social work and assistants;

3) production of printed materials, including information and explanatory nature.

8. The arriving target transfers the authorized body of area provides according to the local budget program 047 "Target current transfers to budgets of areas (the cities of regional value) on implementation of the caused monetary assistance on Orleu's project" according to which transfer to district budgets, budgets of the cities of regional value according to the procedure, established by authorized body on budget implementation is made.

9. The authorized body provides the arriving target transfers according to the local budget program 025 "Implementation of the caused monetary assistance on Orleu's project". According to the specified program the expenses specified in Item 7 of these rules are made.

Payment of ODP is made according to the corresponding subprogrammes of the local budget program 025 "Implementation of the caused monetary assistance on Orleu's project" in the sizes specified in Item 11 of these rules.

10. ODP is provided to family (person) on condition of participation of able-bodied family members (person) in the state measures of assistance of employment and passing in case of need, social adaptation of family members (person), including able-bodied.
