About openness of use of public means

This Law determines conditions and procedure for ensuring access to information on use of public means by managers and receivers of means state and local budgets, subjects of managing of the state-owned and municipal property, funds of obligatory national social insurance.

Section I General provisions

Article 1. Determination of terms and scope of the Law

1. In this Law the stated below terms are used in such value:

1) means of obligatory national social insurance - insurance premiums, the budget receipts and means from other sources arriving for implementation of obligatory national social insurance according to the law;

2) public means - means of the government budget (except secret expenses), the budget of the Autonomous Republic of Crimea and local budgets, the credit resources provided under the state and local guarantees, means of the National Bank of Ukraine, national banks, state trust funds, the Pension fund of Ukraine (further - the Pension fund), funds of obligatory national social insurance, and also the means of subjects of managing of the state-owned and municipal property received by them from their economic activity;

3) subjects of managing of the state-owned and municipal property (further - the companies) - the companies formed in accordance with the established procedure by public authorities, authorities of the Autonomous Republic of Crimea or local government bodies and representatives on receipt of public funds, adoption on them of obligations and implementation of payments, including the state, state, municipal companies, and also economic societies in which authorized capital the state or municipal share fraction (share, shares) exceeds 50 percent, their affiliated enterprises, and also the companies, economic societies in which authorized capital 50 and more percent belong to the state, including state, municipal companies and economic societies in which authorized capital the state or municipal share fraction (share, shares) exceeds 50 percent, merging of such companies.

2. The terms "budget assignment", "budget setting", "budget program", "main manager of budgetary funds", "manager of budgetary funds" and "receiver of budgetary funds" are used in the values given in the Budget code of Ukraine, the term of "means of the Pension fund" - in the value given in the Law of Ukraine "About obligatory national pension insurance", the term of "means of obligatory national social insurance" - in the value given in the laws on separate types of obligatory national social insurance.

3. This Law extends to the relations connected with preparation and publication by managers and receivers of means state and local budgets, the companies, the National Bank of Ukraine, national banks, the state trust funds, and also funds of obligatory national social insurance and bodies of the Pension fund of information on the planned and actual use of public means.

4. Information on use of public means which is information, access to which is limited according to the law, is not subject to publication according to this Law.

Article 2. Single web portal of use of public means

1. Information which will be promulgated according to this Law prepares managers and receivers of means of the Government budget of Ukraine, the budget of the Autonomous Republic of Crimea and local budgets, bodies of the Pension fund, the companies, and also funds of obligatory national social insurance and moves them for the publication on the single web portal of use of public means.

Responsibility for unauthenticity and incompleteness of information promulgated according to this Law are born by heads of managers and receivers of means state and local budgets, the companies, bodies of the Pension fund, and also funds of obligatory national social insurance.

Data which are published according to this Law shall be complete, truthful, exact and really reflect actual data as of the corresponding date or for the corresponding period of time.

2. The single web portal of use of public means is official state information resource on the Internet on which information on this Law is published. The information access, promulgated on the single web portal of use of public means, is free and free.

3. Administration of the single web portal of use of public means and approval of forms on which information on the planned and actual use of public means for promulgation is provided is performed by the subject authorized by the Cabinet of Ministers of Ukraine. The procedure for administration of the single web portal of use of public means affirms the Cabinet of Ministers of Ukraine.

4. Financing of maintenance costs of the single web portal of use of public means is performed at the expense of the government budget.

Article 3. Contents of information on use of public means which is subject to promulgation, and terms of its promulgation

1. Information on use of public means which is subject to promulgation is provided in the forms established by the legislation of Ukraine and shall contain the following data:

1) in case of use of means of the Government budget of Ukraine, the budget of the Autonomous Republic of Crimea and local budgets:

manager (receiver) of budgetary funds (name, identification code of the legal entity, location, surname, name and head's middle name);

main manager of budgetary funds (name, location, surname, name and head's middle name);

amounts of budget settings and/or budgetary appropriations for the corresponding budget period - all and by the budget programs;

amounts of the carried-out expenses of the budget and granted loans from the budget for the accounting period - all and by the budget programs (at the same time also types and amounts of the corresponding receipts on means of special fund of the budget are specified);

information on the agreements signed for the accounting period (the subject of the agreement, the contractor (the name, identification code of the legal entity, the location), the cost of the agreement, unit price (in the presence), quantity of the purchased goods, works and/or services, is carried out procurement procedure or reasons its absence with reference to the law, amount of payments under the agreement in the accounting period, the duration of the agreement);

information on agreement performance, put in the previous accounting periods, with all appendices which are their integral part (the subject of the agreement, the contractor (the name, identification code of the legal entity, the location, surname, name and the head's middle name), the cost of the agreement, unit price (in the presence), procurement procedure or reasons its absence with reference to the law, amount of payments under the agreement in the accounting period, availability or lack of the claims and penalties which resulted from agreement performance, acts of agreement performance (acts of the provided services, reception-transmission, the performed works) in the presence);

the number of official journeys, including with indication of the number of foreign business trips, the total amount of expenses on official journeys, including with indication of amount of expenses on foreign business trips.
