About protection of national non-material cultural heritage

(as amended on 03-06-2023)

This Law the nasyolediya of the Turkmen people governs the relations in the field of protection national non-material cultural; it is directed to realization of the right of citizens of Turkmenistan to access to objects of national non-material cultural heritage and obligation of each person to care for preserving national non-material cultural heritage.

Chapter I. General provisions

Article 1. Concept of national non-material cultural heritage

The national non-material cultural heritage is understood as the cultural wealth inherent in ethnic, social or confessional group of the Turkmen society which are of value with esthetic, welfare, historical and other points of view significant for preserving and development of national and cultural identity of the Turkmen people.

The physical persons having unique capability can act as carriers of national non-material cultural heritage to create, store and transfer to other generations objects of national non-material cultural heritage in invariable traditional forms and invariable traditional means.

Carriers of national non-material cultural heritage can unite both in groups, and in the communities consisting of groups and (or) separate carriers on interests (to areas проявления­ national non-material cultural heritage).

Article 2. Areas of manifestation and objects of national non-material cultural heritage

1. In the territory of Turkmenistan the national non-material cultural heritage can be shown in the following areas:

1) oral traditions and forms of expression, including language as the carrier of non-material cultural heritage;

2) performing arts;

3) customs, ceremonies, festivals;

4) knowledge and skills connected with traditional crafts;

5) knowledge and customs relating to the nature and the Universe.

2. The following objects of national non-material cultural heritage belong to oral traditions and forms of expression:

1) oral folklore, including destana, eposes, legends, fairy tales;

2) ritual and not ritual poetic lyrics;

3) congratulations, plots, riddles, proverbs, sayings;

4) other objects answering to this area of manifestation of national non-material cultural heritage.

3. The following objects of national non-material cultural heritage belong to performing arts:

1) traditions and manifestations of musical art (vocal, tool, dancing and other melodies);

2) the creativity provided in syncretic verbal and musical form (lullabies, crying, ritual wedding songs, songs from ceremonial calendar cycle, song under tool accompaniment, song without tool accompaniment and other songs);

3) traditions and manifestations of choreographic art or choreographic practice (dances, dancing spaces);

4) art of bakhsha, musicians-instrumentalists (dutarch, gidzhakch, tuydukch and other musicians), bakhshi-destanch which means of expression is syncretic language (verbal, musical, drama);

5) national childish sports, national sports;

6) other objects answering to this area of manifestation of national non-material cultural heritage.

4. The following objects of national non-material cultural heritage belong to customs, ceremonies, festivals:

1) national traditions, ceremonies, ceremonies, solemn events, traditional festivals, national holidays;

2) traditional cultural institutes (councils of dear people and elders, maiden sit-round gathering, collective help (генеш);

3) other objects answering to this area of manifestation of national non-material cultural heritage.

5. The following objects of national non-material cultural heritage belong to knowledge and skills connected with traditional crafts:

1) technologies of rug weaving, koshmovalyaniye, production of oriental carpets, embroideries;

2) production of jewelry, potter's art, processing of wood, silk, cotton, wool, skin;

3) technology of preparation of national dishes;

4) manufacturing techniques of clothes and economic stock;

5) traditional architecture;

6) manufacturing techniques of musical instruments;

7) other objects answering to this area of manifestation of national non-material cultural heritage.

6. The following objects of national non-material cultural heritage belong to knowledge and customs relating to the nature and the Universe:

1) national hunting, fishery;

2) agricultural experience, including cultivation of local plant varieties and cultures;

3) livestock production, including experience of cultivation of horses, sheep, cows, camels, dogs and other animals;

4) methods of receipt of paints from local vegetable raw materials;

5) methods of use of medical plants;

6) methods of collection and saving of water;
