agreed as follows:

Article 1

In this Agreement the term "frontier" is understood as the line and the vertical surface passing across this line, the determining limits of the territory of the Russian Federation and the Republic of Kazakhstan on the land, waters, in subsoil and airspace.

Article 2

The initial point of the Russian-Kazakhstan frontier is determined by the separate contract between the Parties.

Article 3

The frontier between the Russian Federation and the Republic of Kazakhstan passes as it is specified in the Description of passing of frontier between the Russian Federation and the Republic of Kazakhstan (Appendix 1) and is represented by firm line of red color on the Card of frontier between the Russian Federation and the Republic of Kazakhstan (Appendix 2). The mentioned appendices constitute integral parts of this Agreement.

Article 4

Any natural changes of beds of the boundary rivers, streams, and also the coastline of reservoirs do not involve changes in provision of the frontier defined by this Agreement if the Parties do not agree about other.

Article 5

For establishment and designation according to this Agreement of frontier on the area, preparation of draft documents of demarcation of the Party form on a parity basis the Joint Russian-Kazakhstan demarcation commission.

Article 6

The mode of frontier is determined by separate contracts between the Parties.

Article 7

The questions connected with development of mineral deposits, operation of the engineering constructions, communications and other infrastructure facilities crossed by frontier or passing on it and also questions of preserving and use of biological resources, water use and protection of the environment are regulated by free standing agreements.

Article 8

This Agreement is subject to ratification and becomes effective from the date of exchange of instruments of ratification.

It is made in the city of Moscow on January 18, 2005, in duplicate, everyone in the Russian and Kazakh languages, and both texts are equally authoritative.
