About approval of the National standard of realtor services of the Republic of Uzbekistan (NSRU No. 3) "Organization of the biddings by real estate objects and rights to them"

According to the Law of the Republic of Uzbekistan "About realtor activities" and the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 10, 2011 "About approval of the Regulations on licensing of realtor activities" the State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition decides No. 129:

1. Approve the National standard of realtor services of the Republic of Uzbekistan (NSRU No. 3) "The organization of the biddings by real estate objects and the rights to them according to appendix.

2. This Resolution becomes effective from the date of its official publication.

National standard of realtor services of the Republic of Uzbekistan (NSRU No. 3) "Organization of the biddings by real estate objects and rights to them"

This National standard of realtor services (NSRU No. 3) "The organization of the biddings by real estate objects and the rights to them" (further - the standard) according to the Law of the Republic of Uzbekistan "About realtor activities" and the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 10, 2011 No. 129 "About approval of the Regulations on licensing of realtor activities" determines the general requirements imposed to the realtor activities performed by rendering services in the organization of the biddings by real estate objects and the rights to them.

Chapter 1. Basic concepts

1. For the purpose of this standard the following basic concepts are used:

auction - bidding form by determination of the applicant with which the agreement on competitive basis in case of which the right to contract with real estate objects and the rights to it is received by the participant who offered the highest price for it is signed. Auctions can be open or closed;

the auctioneer - the physical person having the qualification certificate of the realtor;

the initial price - the price established by the seller of the biddings for exposure of real estate object and the rights to it to the biddings;

the plenipotentiary - person authorized by the participant (applicant) based on the power of attorney for application and participation in auction and tender or legal representatives;

private auction - type of auction in which can take part, specially invited legal entities or physical persons in advance selected by the criteria established by the seller;

closed competition - type of tender in which specially invited legal entities and/or physical persons in advance selected by the criteria established by the seller can take part;

the participant - the applicant or his plenipotentiary allowed to participation in tender or auction;

open auction - type of auction in which any legal entity and/or physical person which declared the intention to acquire real estate object and the rights to it can take part;

open tender - type of tender in which any legal entity and/or physical person which declared the intention to acquire real estate object and the rights to it can take part and to satisfy tender conditions;

the organizer of the biddings - the realtor organization performing the organization of the biddings by real estate objects and the rights to them based on the contract for rendering realtor services signed in the procedure established by the legislation;

the seller - the owner of real estate object or the owner of property right;

the applicant - the legal entity or physical person which declared the intention to participate at the biddings;

tender - bidding form by determination of the applicant with which the agreement, by means of the choice of the best offers provided by participants according to criteria and conditions of the tender documentation is signed. Tenders can be open or closed;

the competitive offer - the offer to sign the agreement on the conditions determined in the tender documentation;

the tender documentation - the set of documents consisting of rules of carrying out tender, forms of competitive offers which contain initial information on technical, commercial, organizational and other characteristics of real estate object and the rights to it, and also about conditions and the procedure of tender provided to applicants by the organizer of the biddings;

tender conditions - the conditions on procedure and the venue of tender, bid price, quantity and the size of real estate objects and the rights to them, encumbrances and other requirements to participants determined by the seller.

Chapter 2. General provisions

2. The purpose of the standard is establishment of conditions and procedure for rendering by organizers of the biddings of services in the organization of the biddings by real estate objects and the rights to them, including realization of real estate object and the rights to it.

3. Task of the standard is establishment of single requirements to rendering services in the organization of the biddings by real estate objects and the rights to them providing their proper quality for consumers of realtor services.

4. The standard is obligatory for application by organizers of the biddings when rendering services in the organization of the biddings by real estate objects and the rights to them.

The standard is not applied on the relations settled by the Regulations on procedure for realization of automotor-vehicles and real estate in case of execution of court resolutions and acts of other bodies approved by the Resolution of the President of the Republic of Uzbekistan of August 31, 2006 No. PP-458 and Regulations on procedure for realization of the state real estate objects approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of October 6, 2014 No. 279.

5. The organizer of the biddings removes on video filming holding the auction process, opening of envelopes with competitive offers and process of their assessment. The organizer of the biddings shall store videos of these shootings in the fireproof safe within three years since their production.
