About procedure for confirmation of the identity of the citizens of the Republic of Belarus who do not have the identity document for pension purposes

According to part two of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of June 3, 2008 "About documentation of the population of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 294

1. Determine that for pension purposes the identity of the citizen of the Republic of Belarus who does not have the identity document (including the citizen of the Republic of Belarus who is earlier documented by the passport refused its use), is confirmed by the conclusion of law-enforcement body in the place of the last registration at the place of residence of this citizen.

2. Approve Regulations on procedure for confirmation of the identity of the citizens of the Republic of Belarus who do not have the identity document for pension purposes it (is applied).

3. To provide to the Ministry of Labour and Social Protection, the Ministry of Communications and Informatization reduction of the regulatory legal acts in compliance with this resolution.

4. This resolution becomes effective from the first following after month of its official publication.

Regulations on procedure for confirmation of the identity of the citizens of the Republic of Belarus who do not have the identity document for pension purposes

1. This Provision determines procedure for confirmation of the identity of the citizens of the Republic of Belarus who do not have the identity document for pension purposes.

2. For confirmation of the personality for pension purposes the citizen of the Republic of Belarus who does not have the identity document (further – the citizen), addresses to management (department) of work, employment and social protection of city, district executive committee, management (department) of social protection of local administration of the area in the city in place of registration at the place of residence or in the place of the actual residence (further – body for work, employment and social protection) with the statement for confirmation of the personality in form according to appendix 1.

Are enclosed to the specified application:

certificate of birth of the citizen;

ten identical color photos corresponding to age of the citizen, 40 x 50 millimeters in size, made according to technical requirements to photos for passports of citizens of the Republic of Belarus;

other documents which are available for the citizen which, in his opinion, can be used for confirmation of his personality.

The body for work, employment and social protection which adopted the statement for confirmation of the personality issues to the citizen the receipt with indication of date of acceptance of this statement and the list of the accepted documents.

3. The body for work, employment and social protection within three working days from the date of reception of an application about confirmation of the personality sends inquiry for confirmation of the identity of the citizen for pension purposes in form according to appendix 2 to law-enforcement body in the place of the last registration at the place of residence of the citizen (further – law-enforcement body).

The documents submitted by it, and also three color photos of this citizen are attached to request about confirmation of the identity of the citizen for pension purposes.

4. Request about confirmation of the identity of the citizen for pension purposes is reviewed by division on nationality and migration of law-enforcement bodies (further – division on nationality and migration) within one month from the date of its obtaining. During consideration the authorized employee of division on nationality and migration has the right to call the citizen for the explanation of necessary data, submission of additional documents.

Information about the citizen concerning which the procedure of identification of the personality is carried out is checked on accounting of division on the nationality and migration, other accounting which are available in law-enforcement body.

The employee of division on nationality and migration who is carrying out the procedure of identification of the personality compares the provided photo of the citizen to the available photos on other documents confirming his personality and establishes their identity.

If the citizen concerning whom the procedure of identification of the personality is carried out was documented by the passport of the citizen of the USSR of sample of 1974 or the passport of the citizen of the Republic of Belarus of sample of 1993 or 1996 the same law-enforcement body, the arrived data earlier, and also photos are compared to data and the photo on the statement on issue of such passport. If the passport was issued by other law-enforcement body, then in the place of its issue the inquiry is sent by the form established by the Ministry of Internal Affairs with the photo of the citizen for identity confirmation.

The data specified in this request and the photo attached to it are compared to the available data and the photo on the statement on issue of the passport specified in part four of this Item. About results of check to the initiator of request the answer with photocopy of this statement goes.

When holding procedure of identification of the identity of the citizen the employee of division on nationality and migration has the right to hold other events for identification of the citizen, including to interview persons who can confirm the citizen's personality. In case of conducting additional check the term of consideration of request about confirmation of the identity of the citizen established in part one of this Item is prolonged according to the decision of the chief of law-enforcement body.
