About approval of the Regulations on the ASAN payment system

Being guided by Item 32 of article 109 of the Constitution of the Azerbaijan Republic, according to the Presidential decree of the Azerbaijan Republic "About expansion of the types of service performed in the centers "Service ASAN" and electronic services and modification of the Presidential decree of the Azerbaijan Republic of September 5, 2012 "About ensuring activities of the State agency on services to citizens and social innovations in case of the President of the Azerbaijan Republic" of February 11, 2014 No. 110 I decide No. 706:

1. Approve "Regulations on the ASAN payment system.

2. To the Cabinet of Ministers of the Azerbaijan Republic:

2.1. in three-months time to prepare and provide to the President of the Azerbaijan Republic offers on reduction of acts of the President of the Azerbaijan Republic to compliance with this Decree;

2.2. in three-months time to provide reduction of regulatory legal acts of the Cabinet of Ministers of the Azerbaijan Republic in compliance with this Decree and to inform on it the President of the Azerbaijan Republic;

2.3. in two-month time to establish in coordination with the President of the Azerbaijan Republic technical requirements for connection to the ASAN payment system and rules of use of the ASAN payment system;

2.4. keep under control reduction of regulatory legal acts of the central executive bodies in compliance with this Decree and in five-months time to inform the President of the Azerbaijan Republic on execution of it;

2.5. resolve other issues following from this Decree.

3. To provide to the Ministry of Justice of the Azerbaijan Republic reduction of regulatory legal acts and acts of normative nature of the central executive bodies in compliance with this Decree and to inform on it the Cabinet of Ministers of the Azerbaijan Republic.

4. To the Ministry of Finance of the Azerbaijan Republic together with the State services agency to citizens and social innovations in case of the President of the Azerbaijan Republic to provide to the President of the Azerbaijan Republic the offers connected with financing of expenses of the organization of action, management and content of the ASAN payment system in a month.

5. To bodies (officials) having power to consider cases on administrative offenses:

5.1. take the measures necessary for connection of information systems and resources to the ASAN payment system.

5.2. provide stable, continued and safe operation of the software for the purpose of real-time transport of decisions on application of administrative punishment in the form of administrative penalty, protocols on the administrative offenses contradicting traffic regulations, photo or video of observations of making of the administrative offenses revealed by means of special technical means in the ASAN payment system.

6. To the state services agency to citizens and social innovations in case of the President of the Azerbaijan Republic:

6.1. take the measures necessary for the organization of action of the ASAN payment system and ensuring its effective use;

6.2. for the purpose of safe and operational implementation of information exchange between the state bodies provided by part 5 of this Decree, and transactions by means of the ASAN payment system to provide use of the gateway of single integration and mobile services (m-Gov).

7. To the state agency of special communication and information security of Special service of the state protection of the Azerbaijan Republic:

7.1. provide state bodies with necessary telecommunication channels for their connection to the ASAN payment system;

7.2. take the measures necessary for safety of the ASAN payment system.

Regulations on the ASAN payment system

1. General provisions

1.1. This Provision is developed based on the Presidential decree of the Azerbaijan Republic of February 11, 2014 No. 110 "About expansion of the types of service performed in the centers "Service ASAN" and electronic services and modification of the Presidential decree of the Azerbaijan Republic of September 5, 2012 No. 706 "About ensuring activities of the State Agency on Rendering Services to Citizens and Social Innovations in case of the President of the Azerbaijan Republic" and determines legal, organizational and technological basis of the ASAN payment system (further - System).

1.2. The system provides the following:

1.2.1. placement in the electronic office created in System, decisions on application of administrative punishment in the form of administrative penalty, protocols on administrative offenses against traffic regulations, rules of safety of traffic and use of highways, photo - or video frames of making of the administrative offenses revealed by means of special technical means and also the message on it on  number of the mobile phone specified in electronic office (short the SMS - the message) and the e-mail address (in the presence) person who made administrative offense;

1.2.2. departure of the claim to the decision on the case of administrative offense;

1.2.3. control over completion dates of decisions on application of administrative punishment in the form of administrative penalty, the notification of persons on the expiration of terms;

1.2.4. payment in electronic procedure via payment terminals, mobile telephone sets and the Internet of administrative penalties, the means which are subject to payment in connection with execution of judgments, the payments provided by the laws of the Azerbaijan Republic "About the state fee", "About notariate", "About banks";.

1.2.5. placement of electronic coupons about passing of vehicles of technical inspection in the electronic offices created in system and informing on it by means of number of the mobile phone specified in the user of system and the e-mail address specified in electronic office (if is available).

1.3. The organization of activities, management and Sistema's development is provided with the operator Sistemy - the State Agency on Rendering Services to Citizens and Social Innovations in case of the President of the Azerbaijan Republic (further - the Operator).
