About approval of Regulations of the Ministry of Defence of the Russian Federation

1. Approve Regulations of the Ministry of Defence of the Russian Federation (appendix No. 1 to this order).

2. To Federal Service for Military-Technical Cooperation, Federal Service for Technical and Export Control:

be guided in practical activities by provisions of Regulations of the Ministry of Defence of the Russian Federation in the part concerning federal executive bodies subordinated to the Ministry of Defence of the Russian Federation;

consider provisions of Regulations of the Ministry of Defence of the Russian Federation in case of development of regulations of federal executive bodies subordinated to the Ministry of Defence of the Russian Federation.

3. To Deputy Ministers of Defence of the Russian Federation, commanders-in-chief of types of the Armed Forces of the Russian Federation, top military commanders of military districts, types of military forces of the Armed Forces of the Russian Federation to provide to heads of the central bodies of military management studying and observance in subordinate bodies of military management of provisions of Regulations of the Ministry of Defence of the Russian Federation.

4. Recognize invalid orders of the Minister of Defence of the Russian Federation according to the List (appendix No. 2 to this order).

5. To impose control over the implementation of this order on the Deputy Minister of Defence of the Russian Federation - the chief of staff of the Minister of Defence of the Russian Federation.

Regulations of the Ministry of Defence of the Russian Federation

I. General provisions

1. The regulations of the Ministry of Defence of the Russian Federation (further - Regulations) according to the Constitution of the Russian Federation, the Federal constitutional Laws and the Federal Laws <*>, acts of the President of the Russian Federation, the Government of the Russian Federation (further - the Government) establish the basic rules of the organization of activities of the Ministry of Defence of the Russian Federation (further - the Ministry of Defence) on implementation of its powers.

The regulations are developed according to legal acts of the Russian Federation, acts of the President of the Russian Federation, the Government and on the basis of Standard regulations of the interaction of federal executive bodies approved by the order of the Government of the Russian Federation of January 19, 2005 No. 30 "About Standard regulations of interaction of federal executive bodies" (The Russian Federation Code, 2005, No. 4, Art. 305; 2017, No. 29, the Art. 4374), and the Standard regulations of the internal organization of federal executive bodies approved by the order of the Government of the Russian Federation of July 28, 2005 No. 452 "About Standard regulations of the internal organization of federal executive bodies" (The Russian Federation Code, 2005, No. 31, Art. 3233; 2017, No. 29, Art. 4374).

2. The Ministry of Defence within the powers will organize execution of the Constitution of the Russian Federation, legal acts of the Russian Federation, acts of the President of the Russian Federation and the Government, international treaties of the Russian Federation, exercises systematic control of their execution in the Armed Forces of the Russian Federation (further - Armed Forces), takes measures for elimination of violations of the law of the Russian Federation, enables development and the realization of state policy, normative legal regulation in the field of defense.

3. In the Ministry of Defence drafts of international treaties (agreements), bills, drafts of decrees and orders of the President of the Russian Federation, resolutions and orders of the Government, and in the cases provided by legal acts of the Russian Federation, acts of the President of the Russian Federation and the Government - drafts of other acts, and also drafts of the conclusions, amendments, official responses on bills are subject to preparation and consideration.

According to orders and instructions of the President of the Russian Federation <*>, according to the orders containing in acts of the Government, protocols of meetings of the Government, the coordinating and advisory bodies of the Government headed by the Russian Prime Minister, Deputy Prime Ministers of Russia according to the orders of the Russian Prime Minister and Deputy Prime Ministers of Russia containing in protocols of the meetings held by them and in resolutions (further - orders of the Government), and also according to addresses of heads of federal executive bodies, other bodies, organizations and citizens in the Ministry of Defence other documents can be prepared and be considered.

4. The drafts of acts and other documents prepared in the Ministry of Defence are submitted in accordance with the established procedure for consideration of the President of the Russian Federation (including concerning implementation of functions of the Supreme Commander by it the Armed Forces of the Russian Federation), in the Government the Minister of Defence of the Russian Federation or person fulfilling its duties if other is not provided in these Regulations and other legal acts.

5. For the purpose of assistance to the Ministry of Defence in ensuring protection and coordination of interests of citizens of the Russian Federation, public associations, the organizations, public authorities in case of the solution of questions in field of activity of the Ministry of Defence according to the Presidential decree of the Russian Federation of August 4, 2006 No. 842 "About procedure for formation of public councils under the federal ministries, the Federal Services and federal agencies which management of activities is performed by the President of the Russian Federation, under the Federal Services and federal agencies subordinated to these federal ministries" (The Russian Federation Code, 2006, No. 32, Art. 3539; 2013, 21, the Art. 2625) is formed No. Public council under the Ministry of Defence <*>.

Structure of the Ministry of Defence and its territorial authorities

6. The structure of the Ministry of Defence, including structure of its central office, affirms the Minister of Defence of the Russian Federation within the established number of staff.

The structure of the Ministry of Defence includes bodies of military management.

7. The structure of bodies of military management and territorial authorities of the Ministry of Defence is determined by the states approved in accordance with the established procedure.

Powers of the leading and other officials of the Ministry of Defence

8. The Minister of Defence of the Russian Federation bears the personal responsibility for the solution of tasks and realization of the powers assigned to the Ministry of Defence will organize its work, conducts meetings of Board of the Ministry of Defence, holds meetings with the leading officials of Armed Forces, including in the video conferencing mode on which the course of accomplishment of the tasks assigned to the Ministry of Defence, orders and instructions of the President of the Russian Federation, orders of the Government is considered makes decisions on the questions carried to its competence represents the Ministry of Defence in the relations with other public authorities, local government bodies, citizens and the organizations, signs on behalf of the Ministry of Defence public contracts (agreements, agreements) and other documents of civil nature, and also performs other powers established by the legislation of the Russian Federation.

10. The Deputy Minister of Defence of the Russian Federation according to its competence, distribution of obligations and powers conferred by the Minister of Defence of the Russian Federation:

a) interacts (including corresponds) with public authorities and other state bodies (including with Administration of the President of the Russian Federation, Government office, Audit Chamber of the Russian Federation, the Prosecutor General's Office of the Russian Federation), local government bodies, the organizations and citizens;

b) performs the common directorship of activities of subordinate bodies of military management and controls it, gives instructions to heads of subordinate bodies of military management, and also gives instructions on the questions carried to its competence, heads of other bodies of military management;

c) holds meetings with the leading officials of Armed Forces (including in the video conferencing mode), representatives of public authorities, local government bodies and organizations;

d) considers the addresses which arrived in the Ministry of Defence, other documents and materials;

e) considers and vises the draft documents represented for the signature to the Minister of Defence of the Russian Federation;

e) performs coordination of drafts of acts and other documents, and in the cases established by the legislation of the Russian Federation signs the conclusions on them;

g) signs on behalf of the Ministry of Defence public contracts (agreements, agreements) and other documents of civil nature based on the power of attorney issued by the Minister of Defence of the Russian Federation;

h) performs other powers, stipulated by the legislation the Russian Federation, these Regulations and legal acts of the Ministry of Defence.

11. The head of body of military management represents the Ministry of Defence according to the powers determined in this Regulations, regulations on body of military management, other legal acts of the Ministry of Defence, official regulations and also based on orders of higher officials of the Ministry of Defence.

12. According to this Regulations, regulations on body of military management, official regulations, orders of higher officials of the Ministry of Defence the head of body of military management:

a) performs direct management of body of military management, bears the personal responsibility for accomplishment of the tasks and functions assigned to body of military management, and also for condition of performing discipline;

b) interacts with other bodies of military management;

c) interacts (including corresponds) with structural divisions of other executive bodies, Audit Chamber of the Russian Federation and the Prosecutor General's Office of the Russian Federation <*>;

d) provides preparation in accordance with the established procedure of drafts of acts and other documents;

e) provides consideration of the addresses which arrived in the Ministry of Defence, drafts of acts and other documents, and also preparation of the conclusions on them;

e) provides consideration of individual and collective addresses of citizens <*> and the organizations, and also information requests about activities of the Ministry of Defence and signs answers to them within the competence;

g) distributes obligations between the deputies, approves regulations on structural divisions, determines (approves) job responsibilities of subordinate officials within the powers;

h) provides in accordance with the established procedure holding the actions connected with passing of military service and Federal public civil service including represents proposals on position assignment and on dismissal, on temporary fulfillment of duties, on advanced training, encouragement of the subordinate military personnel and faces of civil personnel and imposing of penalties on them;

i) attracts in need of established procedure to study of the questions carried to fields of activity of the Ministry of Defence, scientific and other organizations, scientists and specialists;

j) signs the legal acts determined in regulations on body of military management;

k) signs on behalf of the Ministry of Defence based on the powers of attorney issued in accordance with the established procedure public contracts (agreements, agreements) and other documents of civil nature;

l) holds meetings with representatives of public authorities, local government bodies and organizations for the questions carried to its competence;

m) performs personal acceptance of representatives of the organizations and citizens <*>;

o) transfers in accordance with the established procedure to state bodies and the organizations of the Russian Federation the data which are the state secret, carried to field of activity of body of military management;

o) performs other powers established by this Regulations, regulations on body of military management, other legal acts of the Ministry of Defence and orders (instructions) of higher officials of the Ministry of Defence.

The head of body of military management has no right to sign letters on coordination of the drafts of acts which arrived in the Ministry of Defence, and also on the direction of notes and offers on them.

Administrative regulations and standards of provision of the state services

13. Administrative regulations of execution of the state functions and provision of the state services performed and rendered by the Ministry of Defence are developed and affirm as the Ministry of Defence in accordance with the legislation of the Russian Federation <*> (further - administrative regulations).

14. Provision of the state services is performed on the basis of standards of provision of the state services establishing the necessary level of their quality and availability.
