About questions of the conclusion, action and termination of international treaties of the Kyrgyz Republic, and also their state registration and publication

For the purpose of implementation of the Law of the Kyrgyz Republic "About international treaties of the Kyrgyz Republic", according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on Single state system of registration and accounting of international treaties of the Kyrgyz Republic according to appendix 1;

- Procedure for the message on entry into force, suspension of action or denouncement (the termination, exit from) international treaties of the Kyrgyz Republic, and also their publication according to appendix 2.

2. This resolution becomes effective after seven days from the date of official publication.

Regulations on Single state system of registration and accounting of international treaties of the Kyrgyz Republic

1. General provisions

1. The regulations on Single state system of registration and accounting of international treaties of the Kyrgyz Republic (further - the Provision), are developed according to the Law of the Kyrgyz Republic "About international treaties of the Kyrgyz Republic".

2. Subject of regulation of this provision is maintaining Single state system of registration and accounting of international treaties of the Kyrgyz Republic.

3. Action of this provision extends to the international agreements of the Kyrgyz Republic registered and which are stored in the Ministry of Foreign Affairs of the Kyrgyz Republic.

2. The international agreements of the Kyrgyz Republic which are subject to inclusion in Single state system of registration and accounting of international treaties of the Kyrgyz Republic (Unified register)

Within performance of works on the organization of accounting and registration of international treaties of the Kyrgyz Republic the Ministry of Foreign Affairs of the Kyrgyz Republic uses the electronic database for the subsequent accumulation of texts of international treaties of the Kyrgyz Republic in the corresponding database.

Main objectives of accomplishment of this work are:

- creation of single system of accounting of international treaties of the Kyrgyz Republic and provision of the relevant legal information to the ministries and administrative departments of the Kyrgyz Republic, and also legal entities and physical persons;

- creation of single electronic databank of international treaties of the Kyrgyz Republic and forming of the relevant fund of legal information on papers;

- information support by provisions of international treaties of the Kyrgyz Republic of the ministries and administrative departments of the Kyrgyz Republic, and also legal entities and physical persons;

- publication of international treaties of the Kyrgyz Republic, including in electronic form.

5. According to the specified purposes the Ministry of Foreign Affairs of the Kyrgyz Republic carries out the following work:

- conducts inventory count (inventory) of international treaties of the Kyrgyz Republic;

- develops accounting treatment and inclusions of international treaties of the Kyrgyz Republic in the Unified register;

- determines the list of the additional data which are subject to inclusion in the Unified register.

6. The main criteria of forming and maintaining the Unified register are completeness, officiality and reliability of the legal information containing in the Unified register.

3. The international agreements of the Kyrgyz Republic and other documents which are subject to inclusion in the Unified register

7. The international agreements of the Kyrgyz Republic signed with foreign states, and also with the international organizations from name are subject to accounting and inclusion in the Unified register:

- Kyrgyz Republic (interstate agreements);

- Jogorku Kenesh of the Kyrgyz Republic (inter-parliamentary agreements);

- Governments of the Kyrgyz Republic (intergovernmental agreements);

- ministries, state committee and administrative departments, and also other relevant state bodies of the Kyrgyz Republic (interdepartmental agreements).

8. The international agreements of the Kyrgyz Republic containing data of limited access join in the special Section of the Unified register with the corresponding security classification. Types of the specified documents and procedure for their inclusion in the Unified register are regulated by the Law of the Kyrgyz Republic "About protection of the state secrets of the Kyrgyz Republic".

9. For accounting and registration in the Unified register the international interdepartmental agreements of the Kyrgyz Republic go the ministries, the state committee and administrative departments, and also other relevant state bodies of the Kyrgyz Republic to the Ministry of Foreign Affairs of the Kyrgyz Republic in the form of verified copies of the original document on paper and at the same time in electronic form on electronic media.

10. The single state system of registration and accounting of international treaties of the Kyrgyz Republic is performed by the Ministry of Foreign Affairs of the Kyrgyz Republic, and also the relevant state bodies concerning inter-parliamentary and interdepartmental international treaties of the Kyrgyz Republic.

Procedure for the message on entry into force, suspension of action or denouncement (the termination, exit from) international treaties of the Kyrgyz Republic, and also their publication

1. The notification on accomplishment of the interstate procedures necessary for entry into force of interstate and intergovernmental international treaties of the Kyrgyz Republic is performed by the Ministry of Foreign Affairs of the Kyrgyz Republic or other representative on that state body of the Kyrgyz Republic according to regulatory legal act of the Kyrgyz Republic about accomplishment of the interstate procedures necessary for entry into force of interstate and intergovernmental international treaties of the Kyrgyz Republic.
