1. Approve the enclosed Rules of certification in the sphere of extralight aircraft.

2. This resolution is entered into actions after ten calendar days from the date of the first official publication.

Rules of certification in the sphere of extralight aircraft

1. General provisions

1. These rules of certification in the sphere of extralight aircraft (further - Rules) are developed according to the subitem 12) of article 13 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for certification in the sphere of extralight aircraft.

2. The terms and determinations used in these rules:

1) the request - the written appeal of the applicant to authorized body in the sphere of civil aviation for passing of the procedure of certification;

2) the applicant - the physical person or legal entity which addressed to authorized body in the sphere of civil aviation for receipt of the certificate of the flight validity of the aircraft of extralight aircraft;

3) the flight validity - the technical condition of the aircraft corresponding to flight technical characteristics which ensure its safety and flight quality.

3. Certification of the flight validity of aircrafts of extralight aircraft and the flight validity of the aircraft of extralight aircraft which does not have the approved standard design is performed by authorized body in the sphere of civil aviation with involvement of the non-profit organizations uniting operators of aircrafts.

4. For check of technical condition and determination of the validity to flights of the aircraft of extralight aircraft the relevant non-profit organizations in coordination with authorized body in the sphere of civil aviation create the permanent technical commission on inspection of aircrafts of extralight aircraft (further - the technical commission).

The technical commission the skilled technical experts and pilots having practical experience at least five years in operation of aircrafts, specialists of the certified centers, research, assessment and other authorities in coordination with heads of these organizations are included.

2. Certification of the flight validity of the aircraft of extralight aircraft

5. Certification is performed in the following procedure:

1) the applicant submits to authorized body in the sphere of civil aviation the request according to appendix 1 to these rules. The following documents are enclosed to the application:

copy of the certificate of compliance of copy of the aircraft of extralight aircraft or certificate of type;

copy of the certificate on state registration of the aircraft of extralight aircraft;

the copy of the document confirming payment of collection for certification of the flight validity of aircrafts of extralight aircraft.

2) examination of operational technical documentation and determination of the flight validity of the aircraft;

3) decision making and issue (refusal in issue) the certificate.

The authorized body within five calendar days transfers the copy of the request of the technical commission for work on examination of operational documentation and assessment of conformity to the airworthiness standards of civil aircrafts approved by the order of the Government of the Republic of Kazakhstan of July 26, 2011 No. 859.

The applicant provides to members of the technical commission easy access to operational documentation and the aircraft of extralight aircraft.

The technical commission within 20 calendar days carries out works on examination of operational documentation and assessment of conformity to airworthiness standards of the aircraft of extralight aircraft.

6. By results of the carried-out works on examination of operational documentation and assessment of conformity to airworthiness standards of the aircraft of extralight aircraft the technical commission draws up the appraisal report about serviceability of aircrafts of extralight aircraft (further - the act) in triplicate according to appendix 2 to these rules. One copy of the act goes to authorized body in the sphere of civil aviation within 20 calendar days from the date of receipt of the copy of the request from authorized body, the second copy is transferred to the applicant, the third copy remains in the non-profit organization uniting operators of aircrafts.

7. The act issued by the technical commission is the basis for issue or refusal in issue of the certificate of the flight validity.

8. The authorized body in the sphere of civil aviation based on the positive conclusion of the act and the submitted documents issues to the applicant the certificate of the flight validity of the aircraft of extralight aircraft according to appendix 3 to these rules.

9. In case of refusal in issue the repeated request is considered by authorized body in the sphere of civil aviation in case of elimination of the reasons of the previous refusal in issue of the certificate of the flight validity of the aircraft of extralight aircraft.

10. The term of certification of the flight validity of the aircraft of extralight aircraft and issue of the certificate constitutes no more than thirty calendar days from the date of application in authorized body in the sphere of civil aviation.

11. The certificate of the flight validity is issued for a period of one year.

12. For certification of the flight validity of the aircraft of extralight aircraft collection according to the procedure and the size determined by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) is levied. Certification of the flight validity of aircrafts of extralight aircraft is performed after payment in the government budget of the specified collection.
