2. To provide to development department of the gas industry of the Department of Energy of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication of this order in mass media and information system of law of Ad_let;
3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan.
3. To impose control of execution of this order on the supervising Vice-Minister of Energy of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of marginal establishment of prices of wholesale of commodity gas in the domestic market, wholesale and retail sale of the liquefied oil gas within the delivery plan of the liquefied oil gas on the domestic market of the Republic of Kazakhstan out of commodity exchanges (further - Rules), are developed according to the Law of the Republic of Kazakhstan "About gas and gas supply" (further - the Law) and determine procedure for marginal establishment of prices of wholesale of commodity gas in the domestic market, wholesale and retail sale of the liquefied oil gas within the delivery plan of the liquefied oil gas on the domestic market of the Republic of Kazakhstan (further - the delivery plan) out of commodity exchanges.
2. In these rules the following basic concepts are used:
1) the subsoil user - the physical person or legal entity having rights to carrying out transactions on subsurface use;
2) wholesale - business activity on realization commodity, liquefied oil and (or) liquefied natural gas in the domestic market for the purposes of further realization or out of limits of the territory of the Republic of Kazakhstan, and also in cases of gas sale of the gas-distributing organization on normative technical losses and to the consumers included in the list of power plants;
3) petrochemical products - the products received from hydrocarbonic raw materials by implementation of chemical processes and used as finished goods or raw materials for the subsequent chemical transformations;
4) the industrial consumer investor - the legal entity acquiring commodity gas for use in fuel quality and (or) raw materials in industrial production for the purpose of implementation of investment projects on production of petrochemical products and included in the list approved by authorized body and also the legal entity acquiring commodity gas for production, compressed and (or) liquefied natural gas for the purpose of further realization to consumers;
5) authorized body - the central executive body performing state regulation of production, transportation (transportation), storage and wholesale of gas, and also retail sale and consumption of the commodity and liquefied oil gas;
6) the large commercial consumer - the legal entity, except for the industrial consumer investor and the consumer included in the list of power plants, acquiring commodity gas for use in the activities, corresponding to the criteria established in Item 4-1 of article 8 of the Law;
7) the consumer included in the list of power plants - the legal entity included in the list of power plants according to the Law of the Republic of Kazakhstan "About power industry" who uses or will use commodity gas in fuel quality for production of electrical energy.
3. According to Item 2 of article 20 of the marginal Law prices of wholesale of commodity gas in the domestic market are established each five years with breakdown by years and if necessary are adjusted annually on July 1 according to the procedure, determined by authorized body separately for each area, the city of republican value, the capital, the industrial consumers investors acquiring commodity gas for production compressed and (or) liquefied natural gas for the purpose of further realization to consumers taking into account economic and social conditions of gas supply of regions of the Republic of Kazakhstan.
Adjustment is made no more once a year based on the appeal of national operator to authorized body in connection with the change in price of purchase of commodity gas, structure and (or) sources of commodity gas, and (or) subject to state regulation of rates for transportation of commodity gas on trunk gas pipelines, storage of commodity gas in underground gas storages.
For regions of the Republic of Kazakhstan in which there is no supply with commodity gas the marginal level of price of wholesale of commodity gas is not calculated.
