About formation of the Interdepartmental commission on the organization of the conclusion and agreement performance about the Section of products

According to article 5 of the Law of Ukraine "About production sharing agreements" the Cabinet of Ministers of Ukraine decides:

1. Form the Interdepartmental commission on the organization of the conclusion and agreement performance about the Section of products in structure according to appendix.

2. Approve Regulations on the Interdepartmental commission on the organization of the conclusion and agreement performance on distribution of products which is applied.

3. Recognize invalid acts of the Cabinet of Ministers of Ukraine according to the list which is attached.

Regulations on the Interdepartmental commission on the organization of the conclusion and agreement performance on the Section of products

1. The interdepartmental commission on the organization of the conclusion and agreement performance about the Section of products (further - the Commission) is the permanent body formed for the solution of questions of the organization of the conclusion and agreement performance on distribution of products.

2. The commission in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, and also this Provision.

3. The main objectives of the Commission are:

1) preparation and representation of the Cabinet of Ministers of Ukraine of offers on carrying out tender on the conclusion of production sharing agreements (further - agreements);

2) promotion and coordination of work on preparation and coordination of draft agreements;

3) organization of agreement performance.

4. The commission according to the tasks assigned to it:

1) considers addresses of investors with offers on carrying out tender on agreement signature concerning the certain subsoil plot and informs them on results of consideration;

Prepares 2) and represents to the Cabinet of Ministers of Ukraine offers concerning possibility of agreement signature on the Section of products without carrying out tender;

3) will organize work on preparation of offers on determination of conditions of tender;

4) considers the materials provided by participants of tender, holds negotiations with them, prepares and submits to the Cabinet of Ministers of Ukraine proposals concerning determination of winners of tender;

Ensures 5) and coordinates functioning on preparation and coordination of draft agreements, in particular:

will organize conducting examination of draft agreements according to the legislation;

gives to investors conclusions, notes, results of examination or new edition of draft agreements;

provides coordination of the draft agreement with local government body in the territory of which the subsoil plot which according to the draft agreement is transferred to use is located;

develops in some cases according to the decision of the Cabinet of Ministers of Ukraine draft agreements;

6) considers draft agreements and submits to the Cabinet of Ministers of Ukraine proposals in their opinion;

7) considers question of prolongation or early termination of operation of agreements, and also agreements of assignment of rights and obligations under contracts with persons which undertake such rights and obligations, and prepares relevant proposals.

5. The commission has the right:

To receive 1) in accordance with the established procedure from central and local executive bodies, local government bodies, the companies, organizations and the organizations information necessary for accomplishment of the tasks assigned to it;

2) to recruit in the work representatives central and local executive bodies, local government bodies, the companies, organizations and the organizations (in coordination with their heads), and also independent experts, consultants, representatives of the public and mass media (in coordination);

To form 3) in case of need for accomplishment of the tasks assigned to it constants or temporary work groups.

6. The commission in case of accomplishment of the tasks assigned to it interacts with state bodies, local government bodies, the companies, organizations, public and other organizations, investors.

7. The commission attracts the relevant central executive bodies, the companies, organizations and the organizations to conducting examination of draft agreements, including:

financial examination - the Ministry of Finance, GNS;

legal examination - Ministry of Justice;
