About approval of National strategy of the integrated management of frontier for 2015-2017 and the Plan for Strategy implementation

The government DECIDES:

1. Approve:

The national strategy of the integrated management of frontier for 2015-2017, according to appendix No. 1;

The plan for implementation of National strategy of the integrated management of frontier for 2015-2017, according to appendix No. 2.

2. To provide to the ministries and other bodies of system of the integrated management of border within the assigned powers realization of provisions of National strategy of the integrated management of frontier for 2015-2017 and the Plan for Strategy implementation.

3. To national consultation of the integrated management of frontier to submit to the Government semi-annual and monthly reports on implementation of Strategy and the approved Plan within one month after the termination of reporting half-year/year.

4. To impose control of implementation of this resolution on the Ministry of Internal Affairs.

The national strategy of the integrated management of frontier for 2015-2017

I. Description of situation

1. The Republic of Moldova adjoins to external border of the European Union that requires joint approach to boundary perspective. In the same degree, accession to the EU is strategic political goal of the country and provides for the Republic of Moldova, along with other obligations, coordination of provisions, standards and the advanced European practice in the field of management of border. From this the purpose of conceptual and operational compatibility between specialized national and European authorities follows.

The model of the developed management of border in the EU proved the viability, having provided to the Republic of Moldova convincing example of experience and advanced practice. On the one hand, it provides necessary balance between assistance to movement of persons and goods, based on respect for fundamental human rights. On the other hand, allows to warn and fight against illegal migration, cross-border crime and other situations which threaten cross-border security.

Borrowing and application by the Republic of Moldova of the European model of the integrated management of border represents the important strategic decision which allows to develop partnership between our country and the EU in the specific boundary directions. This fact also promotes realization of common goal on maintenance of stability and safety in the region. Development of the European model was implemented within the National strategy of the integrated management of frontier for 2011-2013 that was the first action of this sort in the Republic of Moldova.

The integrated management of frontier at the national level was adopted, developed and reflects the European management model borders, including the following components:

1) control of frontier on the basis of risk analysis and information concerning crime;

2) detection and investigation of cross-border offenses of boundary police in cooperation with other bodies in law scope in the Republic of Moldova;

3) the access model in the Republic of Moldova structured on four filters of control;

4) cooperation between bodies of system of the integrated management of frontier;

5) international cooperation in the field of boundary safety;

6) coordination by means of the National consultation of the integrated management of frontier of activities of bodies of system of the integrated management of frontier.

The national strategy of the integrated management of frontier for 2015-2017 is the main document the politician who reflects priorities and vision of the state in the field of the integrated management of border, for the purpose of safety of borders, the prevention and fight against cross-border crime and illegal migration.

The system of the integrated boundary safety of the Republic of Moldova is component of homeland security. The system of boundary safety of the Republic of Moldova corresponds to model of the safety of the European borders pursuing the prevention and detection of illegal migration and cross-border crime on borders of EU countries.

The integrated boundary safety of the Republic of Moldova designates set of complete, connected and continuous actions and measures by means of which it is provided: integrity of frontier; compliance with law in the field; procedure, public safety and proper implementation of legal activities in border area and in other interested areas; safety of the population; the prevention and fight against illegal migration, cross-border crime, other illegal actions of competent authorities of system of the integrated management of frontier.

National strategy and the Plan for its implementation continue the policy in the field of the integrated management of border initiated by the previous Strategy. This strategy realizes complementarity of views with other documents national the politician and the joint initiatives performed at the European and international level.

Accomplishment of main goal of this Strategy will provide increase in level of safety of border and confidence of people, assistance to legal movement of people and goods through frontier; prevention and fight against illegal migration and cross-border crime; coordination of national legal and procedural base with the legislation of the EU, the best international and European practicians.

This strategy is developed according to the Program of activities of the Government "The European integration: Freedom, Democracy, the Welfare" for 2013-2014 which provides use of the principles of the integrated management of frontier and corresponds to the National development strategy "Moldova — 2020." and base specific public the politician.

During too time, this Strategy promotes realization of strategic objective on the European accession of the Republic of Moldova, and also realization of the reforms following from process of liberalization of visa regime with the EU for citizens of Moldova (took effect since April 28, 2014), and also Agreements on association with the EU (it is signed on June 27, 2014).

In case of development of Strategy the corresponding precepts of law in the field and recommendations of the European and international organizations supporting activities of the Republic of Moldova concerning the integrated management of frontier were taken into account (the relevant European documents on the Integrated management of frontier are provided in appendix No. 1 to this Strategy).

2. Frontier of the Republic of Moldova. The Republic of Moldova is located in the southeast of Europe and borders in the north, the East and the South on Ukraine, and in the West on Romania. Total length of frontier of the Republic of Moldova constitutes 1906 km from which 955 km of land and 951 km water. The border of the Republic of Moldova with Romania down the river constitutes the Prut in length of 684 km. The border with Ukraine constitutes 1222 km from which 267 km water (including down the river Dniester) and 955 km land. The central site of 453,4 of km of the Moldavian-Ukrainian border is under unconstitutional control of separatist authorities of the self-proclaimed Dnestr Moldavian Republic.

3. Boundary safety is national priority that determines the increased concern of the Republic of Moldova concerning the circumstances created by destabilization of situation near the country. Subsequently, poor control of regional development of situation for the last period generates risk of growth of illegal migration, mass appearance of refugees, increases in organized cross-border crime, and also other acts of illegal nature. It constitutes serious danger to development of boundary safety of the Republic of Moldova, including to the state and society, and also the international security.

4. Characteristics of operational situation on border. Within this Strategy the operational situation designates the level of condition of specific types of activity in boundary region in which the bodies having operational powers on border are interested. The operational situation on border of the Republic of Moldova is characterized as difficult that is confirmed by specific indicators in the field.

The prospect of development of indicators determines strengthening tendency by all directions of operational situation and increase in amount of the related activity. From this point there is need of strengthening of complex measures for the prevention and fight against illegal migration, cross-border crime and other actions which are in competence of bodies of system of the integrated management of frontier.

On categories of activities and acts (violations) the operational situation for 2011-2013 was characterized as follows:

1) Flow of people and vehicles. The general flow of the people registered at check points of frontier in 2013 (15,52 of one million crossings of border) grew by 3% in comparison with 2012 and for 4% in comparison with 2011. Growth of mobility of persons is the share as of the Moldavian citizens, so in particular of foreigners. The maximum flow of persons remained on the Moldavian-Ukrainian site of border thanks to regular turnover for the purpose of work more than 50% of the Moldavian migrants in the Russian Federation and Ukraine, and also to visa-free regime for citizens of the Republic of Moldova to countries of the Commonwealth of Independent States (CIS), contrary to restrictions and rules of registration, stay and stay in the Russian Federation. The biggest growth was registered on air border.

Steadily the quantity of the transport units registered at check points of border including the foreign units crossing the territory of the Republic of Moldova increased annually by 2-3%. In 2013 51% of crossings were made on the Moldavian-Ukrainian site, 48% - on the Moldavian-Romanian and 1% - air way. The biggest growth in 4% was registered on the Moldavian-Ukrainian border, especially concerning foreign vehicles with foreign registration numbers.

2) Crossing of frontier without the permission. In 2013 in comparison with 2012 the quantity of cases of crossing of frontier without the permission decreased by 25% and for 29% in comparison with 2011. Most of all cases happened on the Moldavian-Ukrainian site of border (73% of all), is 30% lower in comparison with 2012. This fact speaks about big awareness of the population on rules of entrance/departure from the Republic of Moldova thanks to the got experience and the corresponding informing on legal provisions. After entry into force of the liberalized visa regime with the EU about 30 Moldavian citizens, owners of the new biometric passport, were expelled as earlier were deported from EU countries, and access because they did not conform to legal requirements was not resolved about 100 citizens.

3) Violation of the law about frontier. In 2013 the quantity of cases of violation of the boundary legislation and number of the detained persons increased from 43% and 38% in comparison with 2012 respectively by 74% and 68% in comparison with 2011. Growth was registered both at check points of border, and on the "green" site of border. Most of all acts on "green" border happened because of abuse of regulations of boundary regime. Generally at check points of border stay abuses of regulations were established. The biggest growth of quantity of cases (more than 80%) and numbers of the detained persons happened on air border. Increase in quantity of cases of violations of the boundary legislation reflects growth of efficiency of specialized structures.

4) Illegal migration. The boundary police has powers for identification of cases of illegal crossing of frontier which is performed in the way: avoidance or evasion from control; making of attempt of the omission of border through check points of border, breaking provisions of the current legislation (counterfeit/falsification of travel documents, etc.); abuses of regulations of the omission of border with neighboring countries.

According to indicators of activities of Boundary police during 2009-2013 the quantity of cases of illegal crossing of persons through frontier decreased. Thus, in recent years the number of persons detained for illegal migration decreased approximately by 50% annually (for 56% in 2013 in comparison with 2012), this tendency is valid for overland border, and in case of air border – increased a little.

At the same time, the relation between detentions and illegal crossings is main in case of the last, this fact reflects still rather low level of efficiency in the field, because of insufficiency of personnel and the equipment. In most cases, the detained persons are citizens of the Asian and African countries, such as Afghanistan, Bangladesh, Ghana, Congo, etc. At the same time the quantity of cases of use of the false and forgery documents found when crossing border grew in 2013 by 5% in comparison with 2012, and for 11% in comparison with 2011 that shows strengthening of capabilities of Boundary police to carry out new powers in the field of examination of documents. The biggest growth happened on the Moldavian-Ukrainian site of border.

5) Smuggling. Illicit actions were performed both on "green" border, and at check points of border. Thus, during 2011-2013 1301 cases from which 1183 (90%) at check points of border were revealed. From the point of view of the cost of imushchestvo, the total cost of the detained smuggling constituted approximately 42, thousands of lei from which 90% through check points of border. Thus, it was determined that the majority of illicit actions was made at check points of border that assumes in the future concentration of efforts these divisions of bodies with direct powers on border. On "green" border the quantity of cases in 2013 was doubled in comparison with 2012, and the cost of the detained property grew in 6,7 of times. At check points of border the quantity of cases of smuggling decreased with 458 in 2011 to 334 in 2013 though the cost of the detained property grew approximately by 25%. The fact that only within 9 months 2014 the cost of the detained property grew approximately by 30% in comparison with previous year that speaks about the beginning of actions of divisions of special investigation which increased efficiency of the activities is considerable.

In 2013 the quantity of the detained illicit cigarettes in comparison with 2012 was doubled, most often these cases occurred on "green" border (86% of all). At the same time the quantity of cases of smuggling of cigarettes, and also the detained persons was doubled that specifies growth of efficiency of bodies with direct powers on border (Boundary police and Customs Service). The most part of cases of smuggling was registered on the Moldavian-Romanian site of border.

The tendency of increase in smuggling of alcohol is obvious also on "green" border where its quantity grew by 10 times in the period of 2011-2013.

Concerning vehicles even if variability of quantity of cases is insignificant, cost grew approximately by 30% in 2013 in comparison with 2011.

The quantity of cases of transportation of drugs remained to constants (3-4 in year), amounts fell with kg 9,4 in 2011 to kg 2,38 in 2013. In the first half of 2014 in four established cases kg 80,15, approximately in 40 times more than in 2013 was detained, this fact is also connected with activities of divisions of special investigation.

6) Illegal entrance / departure of vehicles in/from the Republic of Moldova. In 2013 the number of the detained vehicles which tried to drive/leave illegally the Republic of Moldova grew by 18% in comparison with 2012, and only for 4% in comparison with 2011. In particular, the quantity of cases of entrance/departure by counterfeit of powers of attorney grew by the right of control of vehicles.

5. Tendencies of development of operational situation. Assessment of operational situation on border specifies that the geopolitical space inherent in the Republic of Moldova is characterized by the increased pravonarushitelny potential. Moldova is at the same time source, the transit area and zone of purpose of illegal acts. Among manifestations of offenses which can amplify differ: illegal migration and human trafficking; smuggling of cigarettes and tobacco products, alcohol; illegal transportation of vehicles in/from the Republic of Moldova, drug trafficking, the forbidden materials, the acts posing threat to the border services, public order and homeland security.
