According to the subitem 2) of Item 1 of article 16-1 of the Law of the Republic of Kazakhstan of April 12, 2004 "On regulation of trading activity" I ORDER:

1. Approve the enclosed Rules for apportionment of the tariff quotas between participants of foreign trade activity on import to the Republic of Kazakhstan of separate types of meat (further - Rules).

2. To provide to development department of foreign trade activity in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) official publication of this order in information system of law of Ad_let and in periodic printing editions;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To provide to department of regulation of trading activity:

1) implementation of distribution between historical suppliers of amounts of the tariff quotas according to these rules;

2) publication on Internet resource of the Ministry of national economy of the Republic of Kazakhstan of data on amounts of the tariff quotas on import of the separate types of meat (approved, used and which remained unallotted), placement of the relevant information and other procedures specified in these rules.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules for apportionment of the tariff quotas between participants of foreign trade activity on import to the Republic of Kazakhstan of separate types of meat

Chapter 1. General provisions

1. These rules of distribution of the tariff quotas between participants of foreign trade activity on import to the Republic of Kazakhstan of separate types of meat (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 12, 2004 "On regulation of trading activity" (further - the Law on trading activity), the Agreement on the Eurasian Economic Union of May 29, 2014 and the Law of the Republic of Kazakhstan of October 12, 2015 "About ratification of the Protocol on accession of the Republic of Kazakhstan to the Marrakesh agreement on organization of the World Trade Organization of April 15, 1994" (further - the Law) and determine procedure for distribution of the tariff quotas as instrument of regulation of foreign trade activity.

2. In these rules the following determinations and concepts are used:

1) authorized body in the field of development of agro-industrial complex - Ministry of Agriculture of the Republic of Kazakhstan;

2) preceding period - two years which are directly preceding year of application of the tariff quota;

3) the new supplier - legal entity or physical person, being the individual entrepreneur according to the tax legislation of the Republic of Kazakhstan, conforming to the requirements established by these rules;

4) high-quality beef - the meat of cattle included in goods items of 0201 and 0202 Commodity nomenclatures of foreign economic activity of the Eurasian Economic Union (further - the CN FEA EEU), is fresher, cooled or refrigerated, meeting the requirements of the corresponding national standards, or beef worth at least 8000 euros for 1000 kilograms net - masses;

5) authorized body in the field of customs affairs - Ministry of Finance of the Republic of Kazakhstan;

6) supplying countries - the countries with which at the Republic of Kazakhstan the bilateral or multilateral agreements providing release of commodity importation from payment of import customs duties are not signed;

7) the processor - legal entity or physical person, being the individual entrepreneur according to the tax legislation of the Republic of Kazakhstan, corresponding to the following criterion:

performs within the year preceding year of application of the tariff quota, production of the meat products classified by the following codes of the Qualifier of products by types of economic activity:

1013 14 - sausages and products similar of meat, offal meat or blood of animals;

1013 15 - products ready and tinned of meat, offal meat or blood of animals other, except semifinished products ready of meat and offal meat;

8) authorized body in the field of regulation of trading activity - Ministry of Trade and integration of the Republic of Kazakhstan;

9) participants of foreign trade activity are new suppliers, historical suppliers and processors;

10) amount of the tariff quota - goods quantity in kind which import is assessed at the intra quote rates of import customs duties according to the Law;

11) the historical supplier - legal entity or physical person, being the individual entrepreneur according to the tax legislation of the Republic of Kazakhstan, corresponding to the following criteria:

performs commodity importation in preceding period and/or within the year which is directly preceding year in which the tariff quota, from supplying countries in customs procedure "release for internal consumption" is applied;

the commodity importation amount within the year which is directly preceding year in which the tariff quota is applied shall not be less commercially profitable goods quantity;

12) amount of import of the corresponding type of goods by the historical supplier - quantity of the corresponding type of the goods in kind imported by this historical supplier from supplying countries on the territory of the Republic of Kazakhstan into preceding period in customs procedure "release for internal consumption" at inside and extra quote rates of import customs duties;

13) goods:

meat of cattle - the meat included in goods items of the CN FEA EEU 0201 "In meat of cattle is fresher or "The meat of cattle cooled" and 0202 refrigerated", except for high-quality beef (further - KRS meat);

legs of bird - the meat classified by codes of the CN FEA EEU 0207 14 200 1 and 0207 14 600 1 "The refrigerated not rolled half or quarter timbers and legs and pieces of dunghill hens (Gallusdomesticus) of them" (further - legs of bird);

fowl other - the meat included in goods item of the CN FEA EEU 0207 "In the meat and food offal of the poultry specified in goods item of 0105 CN FEA EEU, fresh, cooled or refrigerated", except for codes of the CN FEA EEU 0207 14 200 1 and 0207 14 600 1 (further - fowl other);

14) commercially profitable goods quantity - goods amount more than 25 kilograms.
