Procedure for decision making about suspension of patent grant in the territory of the subject of the Russian Federation

1. This Procedure establishes the sequence of actions in case of decision making about suspension of patent grant in the territory of the subject of the Russian Federation <1>.

The basis for acceptance of FMS of Russia of the decision on suspension of patent grant are motivated offers of federal executive bodies or the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) <1>.

2. The structural division of central office of FMS of Russia performing coordination of activities of divisions of FMS of Russia and its territorial authorities concerning implementation by foreign citizens of labor activity in the territory of the Russian Federation <1>:

2.1. Considers the arrived offers within seven working days;

2.2. By results of consideration of motivated offers prepares the draft of the order of FMS of Russia about decision making about suspension of patent grant <1>;

Sends to structural division of central office of FMS of Russia within which competence questions of conducting legal examination of drafts of legal acts of FMS of Russia <1>, the draft of the order with appendix of all materials which formed the basis of preparation of the draft of the order for conducting legal examination are.

3. The legal division no later than three working days carries out legal expertize by results of which it accepts one of the following decisions:

- approves the draft of the order by putting down of the visa of the chief (deputy chief) of legal division, on the back of the last leaf of the order;

- returns materials in operating unit with appendix of the conclusion containing the corresponding notes and offers for completion.

4. The operating unit reports on the head of FMS of Russia the draft of the order with the enclosed motivated offers approved with legal division.

5. The operating unit without delay after signing of the order sends its verified copy to the territorial authority of FMS of Russia located in the territory of subject of the Russian Federation on which the decision on patent grant suspension is made and also notifies on the made decision federal executive body or the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) respectively, provided motivated offers.

6. The territorial authority of FMS of Russia within ten calendar days from the date of the edition of the order stops patent grant.
