According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of creation is estimated, forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state control by the Public archive agency, according to appendix is determined.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of December 15, 2010 No. 1230 "About approval of criteria by which the risk degree from implementation of economic activity in the field of creation is estimated of forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state supervision (control) is determined" (The Official Bulletin of Ukraine, 2011, No. 1, the Art. 15).

Criteria by which the risk degree from implementation of economic activity in the field of creation is estimated, forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state control by the Public archive agency is determined

1. Criteria by which the risk degree from implementation of economic activity in the field of creation, forming, maintaining and use of insurance fund of documentation is estimated are:

value for economy and safety of the state;

appointment of insurance fund of documentation;

observance of requirements of the legislation concerning creation, forming, maintaining and use of insurance fund of documentation.

2. According to the established criteria subjects of managing treat one of three risk degrees - high, average and insignificant.

3. With high risk concern subjects which to subjects of managing:

perform activities which have strategic importance for economy and safety of the state;

are contractors of the state defense order;

perform mobilization task;

provide storage of insurance fund of documentation;

are owners, own, use life support system and transport communications of nation-wide level;

perform activities on potentially dangerous objects of the national level;

are owners, own, use cultural heritage and cultural values of national value;

allowed within year of violation of requirements of the legislation in the field of insurance fund of documentation.

4. With average risk degree concern subjects which to subjects of managing:

are owners, own, use life support system and transport communications of the regional level;

perform activities on potentially dangerous objects of regional and local level;

are owners, own, use cultural heritage and cultural values of local value;

perform production of documents of insurance fund of documentation.

5. Subjects of system of insurance fund of documentation which are not carried to subjects of managing with high and average risk degree concern to subjects of managing with insignificant risk degree.

6. If the subject of managing can be carried at the same time to two or more risk degrees, such subject belongs to more high risk from to what it can be carried.

7. Scheduled inspections of subjects of managing are carried out:

with high risk - is not more often than once a year;

with average risk degree - is not more often than once in three years;

with insignificant risk degree - is not more often than once in five years.

8. If by results of implementation of actions of the state control of the subjects of managing carried to high or average risk degree for the last three years the facts of violation of requirements of the legislation in the field of insurance fund of documentation are not elicited, the moratorium on holding planned actions of the state control for the next one or three years respectively is applied to such subjects of managing.

If by results of implementation of actions of the state control of the subjects of managing belonging to insignificant risk degree for the last five years the facts of violation of requirements of the legislation in the field of insurance fund of documentation are not elicited, the moratorium on carrying out planned measures of the state control for the next five years is applied to such subjects of managing.
