About exchange of statistical and analytical information

Administration of the State Border Service of Ukraine and Department of boundary police of the Ministry of Internal Affairs of the Republic of Moldova (further - the Parties),

being guided by Articles 1, 2 Contracts between the Cabinet of Ministers of Ukraine, the Government of the Republic of Moldova and the Government of Romania on cooperation in fight against crime, signed on July 6, 1999 to Kiev (further - the Agreement),

for the purpose of coordination of the measures taken by the State Border Service of Ukraine and the Department of boundary police of the Ministry of Internal Affairs of the Republic of Moldova on the Ukrainian-Moldavian frontier on prevention of illicit movement through frontier of persons, vehicles, loads and other property, and also the solution of other questions which is within their competence

agreed as follows:

Article 1

The parties perform exchange of statistical and analytical information on situation on frontier and forecasts of its development, and also about the main results of office activities of the State Border Service of Ukraine and Department of boundary police of the Ministry of Internal Affairs of the Republic of Moldova according to the List of data according to which mutual exchange of information is performed, specified in appendix to the this Protocol.

The parties can perform exchange and the other information which is of mutual interest and promotes goal achievement of the this Protocol.

Article 2

Exchange of information between the Parties is performed according to the legislation of the states of the Parties, and also international treaties which participants they are.

Within this Protocol exchange of information with limited access is not made.

The parties not allow disclosure of data and other information obtained in the course of cooperation within realization of the this Protocol and not to transfer them to the third party without written consent of the Party which provided information.

Article 3

Exchange of information is performed between:

1. Administration of the State Border Service of Ukraine and Department of boundary police of the Ministry of Internal Affairs of the Republic of Moldova:

monthly - to the 20th following the corresponding period;

quarterly - to the 25th following the corresponding period.

The parties communicate about situations and results of office activities for all sites of borders of the states of the Parties.

2. Chernivtsi, Mogilev-Podolsk boundary group of the State Border Service of Ukraine and Regional government of "Nord" of Boundary police of the Republic of Moldova; Kotovsk, Belgorod-Dniester boundary groups of the State Border Service of Ukraine and Regional government of "Est" of Boundary police of the Republic of Moldova; Belgorod-Dniester, the Izmail boundary group of the State Border Service of Ukraine and Regional government of "Sud" of Boundary police of the Republic of Moldova monthly - to the 15th following the corresponding period.

3. service of the Parties on duty with use of the operating communication channels:

every day - till 10:00 on agreed form;

in case of unexpected situations - immediately.

4. Seniors of changes in check points through the Ukrainian-Moldavian frontier:

every day - till 06:00 for the last days

in case of unexpected situations - immediately.

The parties in ten-day time after entry into force of the this Protocol will exchange contact information of the competent divisions specified in Items 1, 2 and 3 these Articles.

In case of change in data of the specified divisions of the Party without delay notify on this each other.

Article 4

The parties, in case of need, through the competent authorities of Ukraine and the Republic of Moldova determined by article 3 of the Agreement can communicate on separate requests according to the procedure, determined by Articles 4, 5 Agreements.

Article 5

For the purpose of realization of provisions of the this Protocol and the solution of the questions arising in the course of cooperation and interaction, the Parties hold working meetings and consultations. The venue of meetings and the list of the discussed questions are approved routinely.

Article 6

Exchange of information is performed in the form of office correspondence, during the meetings of agents of the parties, and also with use of magnetic, optical data carriers, e-mail, telephone and fax connection.

Exchange of information between the Parties within the this Protocol is performed in Russian. As agreed by the parties information is provided in other language.

Article 7

Each Party independently covers the expenses connected with realization of provisions of the this Protocol.

Article 8

The this Protocol consists sine die and becomes effective from the date of its signing.

Along with entry into force of the this Protocol the Protocol between Administration of the State Border Service of Ukraine and the Border service of the Republic of Moldova on exchange of information signed to Brussels on November 21, 2006 terminates.

By mutual consent of the Party can make changes and additions to the this Protocol which are drawn up by the additional Protocol which is integral part of the this Protocol and becomes effective from the date of its signing.

Each of the Parties can terminate the this Protocol by the direction diplomatic channels to other Party of the written notice of intention to stop its action. In this case it stops the action in 90 days from the date of receipt of such notification.

It is made to Chisinau on November 20, 2014 in duplicate, everyone in the Ukrainian, Romanian and Russian languages, and both texts are equally authoritative. In case of disagreements in case of interpretation of provisions of the this Protocol the text in Russian is taken as basis.
