1. Approve the enclosed Rules of issue of the distribution certificate on the movie.

2. For culture and art of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation to provide to department:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) after official publication placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan.

3. Declare invalid:

1) the order of the Minister of Cultural Affairs of the Republic of Kazakhstan of March 14, 2011 No. 46 "About approval of form of the distribution certificate on the movie" (it is registered in the Register of state registration of regulatory legal acts for No. 6876, No. 160 is published in the republican newspaper "Kazakhstanskaya Pravda" of May 19, 2011, (26581));

2) the order of the Minister of Culture and Information of the Republic of Kazakhstan of September 25, 2013 No. 226 "About modification of the order of the Minister of Cultural Affairs of the Republic of Kazakhstan of March 14, 2011 No. 46 "About approval of form of the distribution certificate on the movie" (it is registered in the Register of state registration of regulatory legal acts for No. 8845, No. 309 is published in the republican newspaper "Kazakhstanskaya Pravda" of November 6, 2013 (27583)).

4. This order becomes effective after day of its first official publication.

Rules of issue of the distribution certificate on the movie

1. General provisions

1. These rules of issue of the distribution certificate on the movie (further - Rules) determine procedure for issue of the distribution certificate on the movie (further - the distribution certificate).

2. The distribution certificate on the movie is the document which is the basis for hire in which technical data on the movie, information on creators, index and genre of the movie are specified, issued in electronic form.

3. The distribution certificate is issued on the movies made in the Republic of Kazakhstan, and also imported (delivered) into the Republic of Kazakhstan for hire and public display (demonstration) except for of the movies imported (delivered) for demonstration at festivals, seminars, retrospective and other actions, and also made by the cinema organizations of the former USSR.

2. Procedure for issue of the distribution certificate on the movie

4. For receipt of the distribution certificate the applicant needs to provide to office of authorized body in the field of culture (further - authorized body) or through the web portal of "the electronic government": www.egov.kz (further - the portal) the following documents:

1) the statement in form, according to appendix to these rules, or on the portal request in electronic form, the applicant certified by the digital signature;

1-1) documents proving the identity and (or) the power of attorney of the legal entity or notarially attested power of attorney (for physical person) - in case of the address of the representative of the applicant (are required for identification of the personality);

2) the documents confirming the applicant's right to the movie or to its use (the copy of author's agreements and (or) license agreements). Notarially attested copy in the Kazakh and (or) Russian languages is attached to documents in foreign language. If the notary does not know the corresponding languages, transfer can be made by the translator whose authenticity of the signature is witnessed by the notary;

3) the summary of the movie which shall contain information on contents of the movie with the description of all available scenes for determination of the age spectator qualification on the movie;

4) data on the works used in movies domestic or coproduction.

In case of the address through the portal the documents specified in subitems 2), 3) and 4) of this Item are attached to request in electronic form in the form of the scanned copies.

5. The application (request) for receipt of the distribution certificate is considered within seven working days from the date of receipt in authorized body.

6. Issue of the distribution certificate on the movie is performed in the form approved by the order of the Minister for Culture and Sports of the Republic of Kazakhstan of November 30, 2015 No. 366 "About approval of form of the distribution certificate on the movie" registered in the Register of state registration of regulatory legal acts at No. 12460. The distribution certificate is drawn up in electronic form, the head of authorized body certified by the digital signature, goes to personal account of the applicant to the portal, or is issued on paper.

7. Issue of the distribution certificate by authorized body is performed free of charge.

8. Movies on which distribution certificates are issued are registered in the State register of movies.

9. The authorized body refuses to the applicant issue of the distribution certificate on the movie on the following bases:

1) provision by the applicant of the doubtful or distorted information;

2) representation by the applicant of the documents which are not corresponding to item 4 of these rules;

2-1) concerning the applicant there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain state service which took legal effect;

3) if contents of the movie are directed to promotion or propaganda of violent change of the constitutional system, violation of integrity of the Republic, undermining safety of the state, kindling of national discord.

10. In case of the address in paper form the refusal is issued through office of authorized body, and electronically - through the portal.

11. In cases if the authorized body did not issue at the scheduled time the distribution certificate or did not provide motivated refusal in issue of the distribution certificate, then from the date of the expiration of terms of their issue the distribution certificate is considered issued.
