THE AGREEMENT ON COOPERATION IN THE FIELD OF THE SMALL BUSINESS BETWEEN THE MINISTRY OF ECONOMICS OF THE REPUBLIC OF BELARUS AND THE STATE COMMITTEE OF UKRAINE CONCERNING REGULATORY POLICY AND THE ENTREPRENEURSHIP

of August 1, 2002

The Ministry of Economics of the Republic of Belarus and the State committee of Ukraine concerning regulatory policy and entrepreneurship which further are referred to as with the Parties according to the Support agreement and development of small business in the State Parties of the CIS signed on January 17, 1997 in the city of Moscow for the purpose of:

simplification and assistance to cooperation between two states in the field of development of small business, and also to bilateral cooperation between the Belarusian and Ukrainian entrepreneurs,

establishments of the general directions of development of cooperation between the Ministry of Economics of the Republic of Belarus and the State committee of Ukraine concerning regulatory policy and entrepreneurship in the field of support and development of entrepreneurship

agreed as follows:

Article 1

Found the Belarusian-Ukrainian working group on development of small business (further - the Working group).

Article 2

According to the legislation of the Republic of Belarus and Ukraine and depending on possibility of use of available means the Working group will solve wide range of the questions including the following directions:

assistance to rapprochement of national legal systems in questions of regulation of activities of small business entities;

development of recommendations and offers on creation of conditions for development of small business;

experience exchange in the field of support of small business;

assistance to development of infrastructure of support of small business;

development and implementation of joint programs and projects, actions plans on assistance to small business entities, on exchange and training of entrepreneurs, and also the government employees participating in development of small business;

creation of common information space and forming of conditions for operational exchange of information concerning carrying out state policy in the field of support and development of small business, and also on topical issues of business activity;

the analysis of condition and development of small business in the Republic of Belarus and Ukraine, creation of forecasts in the field of support and development of small business;

assistance in holding the trade fairs, exhibitions and other actions directed to promotion of products of small business entities in the markets of the Republic of Belarus and Ukraine;

organization of joint consultations, seminars and symposiums;

assistance in supply of materials and the equipment within jointly implementable programs and projects;

attraction and coordination of activities of the interested organizations for accomplishment of this agreement;

the joint publication of Articles, books, reports and distribution of information on results of the researches which are of interest in the field of small business;

exchange of information about export offers of the small and medium companies of the Republic of Belarus and Ukraine through the trade and economic missions of diplomatic representations of both countries, and also other forms of cooperation which are not contradicting the current legislation of both Parties.

Article 3

The working group will consist of two sections - Belarusian and Ukrainian, headed by two cochairmen:

for the Belarusian section - the deputy minister of economy of the Republic of Belarus;

for the Ukrainian section - the vice-chairman of the State committee of Ukraine concerning regulatory policy and entrepreneurship.

Decisions of the Working group are made according to Regulations which are approved by both cochairmen.

Article 4

Each of sections shall consist of representatives of bodies of the state support of small business, associations of entrepreneurs, Chambers of Commerce and Industry and representatives of small business.

Quantitative and the members of sections affirm the corresponding cochairmen under approval between them and proceeding from feasibility.

Article 5

The working group performs joint coordination of the activities and gathers at least once in half a year by mutual consent of the Parties. Work plans, joint programs and recommendations of the Working group shall be provided at least in 30 working days prior to day of convocation by the Parties for preliminary consideration.

Article 6

Official language of the Working group is Russian.

Article 7

By mutual consent of the Parties about cooperation changes and additions can be made to this agreement.

Changes and amendments are drawn up by the separate Protocols which are integral part of this agreement and becoming effective after signing in accordance with the established procedure according to the national legal system of the states of the Parties.

Article 8

This agreement becomes effective from the moment of its signing by the Parties and is effective until one of the Parties does not notify at least in six months other Party in writing on intention to stop its action.

Cancellation of this agreement will not influence execution of the agreements and transactions made based on this Agreement between the Parties.
