AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF BELARUS AND CABINET OF MINISTERS OF UKRAINE ON PRODUCTION AND SCIENTIFIC AND TECHNICAL COOPERATION

The government of the Republic of Belarus and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

being guided by the principles provided by the Agreement on general terms and the mechanism of support of development of production cooperation of the companies and industries of the State Parties of the Commonwealth of Independent States of December 23, 1993

attaching importance to further development economic and sci-tech cooperation for the benefit of both states,

aiming to provide favorable conditions for development and implementation of joint programs, development and enhancement of mutually advantageous production bonds on the basis of cooperation, agreed as follows:

Article 1

The parties will promote implementation and development of production and scientific and technical cooperation between the companies of all patterns of ownership on the basis of direct production connections and their specialization.

Article 2

The parties will hold necessary events for the purpose of development of the international specialization and cooperation of production, providing conditions of their implementation, determination of priorities in industries, assistance to development and realization of joint projects, programs, production coordination implementation.

Article 3

This agreement is applied to deliveries of goods and rendering the services necessary for implementation of joint interstate programs, and also as agreed by the parties the major components and products which are not made in the consuming country used for production of end products.

The nomenclature and amounts of the cooperated deliveries, and also the business entities performing these deliveries are determined for the corresponding year by the executive bodies of the Parties authorized by the Protocol between the Parties which is integral part of this agreement.

Article 4

The parties not apply import and export customs duties, the value added tax, quantitative restrictions of export and import to goods delivered in production cooperation according to Article 3 of this agreement.

Article 5

Deliveries of goods and rendering services within this agreement are performed on the basis of contracts (contracts) between the Ukrainian and Belarusian business entities using settlement on contract prices.

Responsibility for agreement performance (contracts) is born by the business entities who imprisoned them.

Article 6

All matters of argument which arise between subjects of managing by delivery of products according to this agreement are solved according to the procedure, stipulated by the legislation and contracts.

Article 7

Goods delivered in production cooperation within this agreement scientific and technical information on them are not subject to re-export to the third countries if the Parties did not agree about other. In this case such arrangement will be fixed in the Protocol, stipulated in Article 3 this agreements.

Article 8

The parties, in case of need, by negotiations and consultations approve conditions of loan granting and investments which stimulate development of cooperation in the knowledge-intensive productions and export-oriented industries, and also release of importozameshchayemy products.

Article 9

The disputes which arose in connection with interpretation and execution of this agreement and Protocols to it are permitted by mutual consultations and negotiations between the Parties.

Article 10

In the written consent of the Parties changes and additions can be made to this agreement.

Article 11

Execution of provisions of this agreement does not affect the rights and obligations following from other international treaties of the Parties.

Article 12

This agreement becomes effective from the date of receipt of the last written notice confirming accomplishment of the interstate procedures by the Parties necessary for its introduction in force.

The agreement is effective within three years and is automatically prolonged for the subsequent year periods.

The Agreement is terminated after six months from the date of receipt of one of the Parties of the written notice of other Party of the intention to stop its action.

It is made in Chernihiv on May 29, 2002 in duplicate, everyone in the Russian and Ukrainian languages, and all texts are equally authoritative and are authentic.
