1. Approve the enclosed Rules of issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances.

2. To provide to committee of ecological regulation, control and state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in mass media and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This resolution becomes effective after ten calendar days after its first official publication.

The rule of issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance containing ozone-depleting substances

1. These rules of issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances (further - Rules) are developed according to the subitem 30) of article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 and determine procedure for issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances.

2. Legal entities and individual entrepreneurs for receipt of the permission to works with use of ozone-depleting substances, repair, installation, equipment maintenance containing ozone-depleting substances (further - permission), represent to authorized body in the field of environmental protection (further - authorized body) the following documents:

1) the request for issue of the permission to works with use of ozone-depleting substances, repair, installation, equipment maintenance containing ozone-depleting substances in form according to appendix 1 to these rules;

2) form of data with documents, at least two employees confirming availability in staff of the applicant - the executives in charge having the corresponding higher education and length of service in at least three years or the corresponding secondary vocational education and length of service in at least five years according to appendix 2 to these rules;

3) the copy of the certificate * or the certificate of state registration (re-registration) of the legal entity or the certificate on state registration of the individual entrepreneur acting without formation of legal entity;

* the certificate on state registration (re-registration) of the legal entity (branch, representation) issued before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning state registration of legal entities and accounting registration of branches and representations" is valid before the termination of activities of the legal entity.

3. Permission is issued by authorized body in form according to appendix 3 to these rules.

4. Permission is issued by authorized body no later than ten working days, and for small business entities no later than five working days from the date of submission of the statement with the relevant documents.

In cases not of representation by authorized body at the scheduled time of the motivated refusal permission is considered issued (the procedure approved).

5. To the applicant the motivated answer about refusal in further review of the statement in cases goes:

1) establishment of unauthenticity of the documents submitted by the applicant for receipt of the state service, and (or) these (data) containing in them;

2) discrepancies of the applicant to allowing requirements;

3) concerning the applicant there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain state service which took legal effect;

4) concerning the applicant there is judgment which took legal effect based on which the applicant is deprived of the special right connected with receipt of the state service.

In cases of representation by the applicant of incomplete document package, the authorized body within 2 (two) working days gives motivated refusal in further review of the statement.

6. Permission to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances, is issued for a period of three calendar years.

7. The authorized body records the issued permissions by means of information system of the state E-licensing database.
