1. The presents the Procedure and the amount of compensation of damage are developed according to Article 71 of the Forest code of the Republic of Tajikistan.
2. Operation of this resolution extends to forest fund and other objects of plant and animal life, being under natural conditions on the lands having nature protection value on farmlands and lands of the state inventory.
3. The amount of compensation of the damage caused to forest fund and other objects of plant and animal life by physical persons and legal entities it is estimated according to the Law of the Republic of Tajikistan "About indicators for calculations".
4. Compensation of the damage caused to forest fund and other objects of plant and animal life by legal entities and physical persons does not exempt them from liability, provided by the Code of the Republic of Tajikistan about administrative offenses.
5. The physical persons and legal entities which made violation of requirements of regulatory legal acts in the field of forest fund and to other objects of plant and animal life and found guilty indemnify the loss caused to forest fund and other objects of plant and animal life in compliance by this Procedure.
6. The damage caused to forest fund as a result of the fire or the negligent relation with fire and also cost of all expenses on fire extinguishing, are compensated according to the legislation of the Republic of Tajikistan.
