Agreement between the Government of the Republic of Belarus and Government of the Republic of Moldova on sci-tech cooperation

of November 13, 2003

Became effective on March 26, 2004.

The government of the Republic of Belarus and the Government of the Republic of Moldova which are hereinafter referred to as by the Parties

convinced that the sci-tech cooperation is important component of complex of the bilateral relations,

wishing to develop and strengthen cooperation between two states in science and technology, making thereby contribution to economic and social development of two states,

agreed as follows:

Article 1

The parties will help sci-tech cooperation on the basis of the principles of equality and mutual advantage, creating for this purpose necessary organizational, legal and economic conditions.

Article 2

The cooperation within this agreement will be performed with observance of the international obligations of the Parties and according to the legislation of the states.

Article 3

The directions of bilateral sci-tech cooperation will be determined proceeding from the priority directions and interests of development of science and technology of both states.

Article 4

The cooperation within this agreement will be implemented in the following forms:

consultations concerning forming and realization of scientific and technical policy in both states;

implementation of joint scientific and technical programs and projects;

creation of the joint research organizations;

forming of joint temporary research teams, and also the innovative companies providing development of the new equipment and technologies;

the organization of joint scientific operation in research establishments, on industrial enterprises, in higher educational institutions, technoparks of the state of other Party, including joint field surveys and expeditions;

involvement of certain scientists and specialists of one of the states to performance of work in another;

holding joint seminars, scientific conferences, meetings and exhibitions.

The cooperation can be performed also in other mutually agreed forms providing implementation of this agreement.

In case of the choice and determination of forms of support of specific joint surveys of the Party are guided only by interests of development of science and relevance of subject for economic and social progress of both states.

Article 5

The cooperation on implementation of this agreement will be performed by the ministries, other state bodies, academies of Sciences, research establishments, higher educational institutions, scientific and other organizations, certain scientists and specialists of the states of the Parties within their competence on the basis of direct agreements according to the legislation of the states of the Parties.

The purpose and content of cooperation, the name of the cooperating organizations, their financial liabilities, and also procedure for use of results of joint scientific research and other information obtained when implementing scientific research and the questions connected with protection of objects of industrial property and copyright of intellectual property shall be, as a rule, reflected in the specified agreements.

The common directorship and coordination of cooperation will be performed by Committee on science and technologies under Council of Ministers of the Republic of Belarus (the Belarusian Side) and the Supreme Council on science and technology development of the Republic of Moldova (the Moldavian Side).

Article 6

For the purpose of implementation of this agreement of the Party will create the joint Commission on sci-tech cooperation questions. The Commission develops for the organization of the activities and approves regulations of work.

Article 7

The parties consider that scientific and scientific and technical information which is obtained during cooperation within this agreement does not belong to industrial property and is open for publication according to the legislation of the states of the Parties, in case of mutual consent of the Parties will be open for world scientific community by use of the commonly accepted methods of its distribution.

Article 8

The parties will pay special attention to ensuring access of scientists of both states to the unique and latest experimental equipment, and also will cooperate in its development and production, in particular, for cooperation in the forms specified in Article 4.

Article 9

The parties will aim at creating favorable conditions for stay in the territory of both states of scientists and specialists, exchange of scientific devices and the equipment, scientific and technical documentation in case of accomplishment of joint surveys and developments.

Article 10

The measures provided in the Agreement will be realized within financial opportunities of the Parties.

Article 11

This agreement does not affect the rights and obligations of the Parties following from other international agreements signed by them.

Article 12

By agreement of the parties changes and additions which are drawn up by separate protocols can be made to this agreement and are integral part of this agreement. The called protocols become effective according to the procedure of entry into force which is established for this agreement.

Article 13

This agreement becomes effective from the date of the last written notice through diplomatic channels of accomplishment of the interstate procedures by the Parties necessary for its entry into force. The agreement will be effective within five years and to be prolonged automatically for the next five years provided that any of the Parties will not notify in writing other Party on the intention to stop its action not later than 6 months.

Change or cancellation of this agreement will not influence the projects begun on its basis which implementation will be continued on agreed terms.

It is made in Minsk on November 13, 2003 in duplicate in the Russian and Moldavian languages, and both texts are equally authoritative.
