For the purpose of execution of provisions of part (2) Article 5 and article 47 of the Law No. 185 of July 11, 2012 on prevention of dope in sport and fight against it (The official monitor of the Republic of Moldova, 2013, Art. No. 1-5, 2) DECIDES: the Government

1. Approve:

Regulations on the organization and functioning of the National anti-doping agency according to appendix No. 1;

Structure of the National anti-doping agency according to appendix No. 2.

2. Establish the extreme number of staff of the National anti-doping agency in number of 6 units with total annual wages, according to the current legislation.

Regulations on the organization and functioning of the National anti-doping agency

Chapter I. Basic provisions

1. The regulations on the organization and functioning of the National anti-doping agency (further – the Provision) regulate tasks, the main functions, powers and the rights of the National anti-doping agency (further – the Agency), and also the organization of its activities.

2. The agency is public organization of legal nature in subordination of the Government which has seal with the coat of arms of the state and the name in state language, and also treasurer accounts.

3. The agency the politician provides the prevention and fight at the national level against the dope phenomenon by development and realization anti-doping and governed, encouragement of practice of net sport for the purpose of health protection of athletes and respect for the principles of fair competition in sport, promotions and supports of researches of the phenomenon of dope in sport.

4. The agency performs activities according to provisions of the Constitution of the Republic of Moldova and the current legislation, resolutions of Parliament, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, other regulations, international treaties which part is the Republic of Moldova, and also according to this Provision.

5. Financing of the Agency is performed at the expense of the government budget, from the special funds created and administered according to the current legislation and also donations and the sponsor's help.

Chapter II. Tasks, main functions, powers and rights of the Agency

Section 1. Tasks and main functions of the Agency

The agency the politician in the field of the prevention and fight at the national level against the phenomenon of dope, encouragement the practician of net sport for the purpose of health protection of athletes, promotion and support of researches of the phenomenon of dope in sport, and also development of special provisions in areas of the activities, including their reduction in compliance with international standards and regulations has tasks on providing and support of realization of the purposes of the Program by development, promotion and implementation.

7. For implementation of the tasks the Agency performs the following main functions:

1) development and realization within the competence of programs and national plans of action of the following areas: the prevention and fight at the national level against the dope phenomenon, encouragement of practice of net sport for the purpose of health protection of athletes and respect for the principle of fair play in sport;

2) promotion and support of researches of the phenomenon of dope in sport;

3) cooperation with specialized central bodies of public management, National Olympic and sports committee and sports structures from the point of view of development and promotion of the programs and plans connected with this area;

4) management, development and approval of financing, and also control of use of money for the purpose of implementation of the annual programs relating to field of activity of the Agency;

5) the organization and coordinating of implementation the politician in the field of the competence, ensuring single application of the national and international legal system in the considered area;

6) support of scientific research in the field of the prevention and fight against the dope phenomenon in sport;

7) ensuring international cooperation in the field of the prevention and fight against the dope phenomenon in sport by the conclusion and execution of international agreements and agreements in the field;

8) the organization and implementation according to the current legislation of public purchase of goods, services and works for the needs relating to field of activity of the Agency;

9) coordination of activities for preparation, training and occupational retraining in sphere of activity;

10) the organization of seminars, conferences, thematic symposiums and establishment of international cooperation in spheres of the activities;

11) support and taking measures for acceleration of process of attraction of foreign investments to this area;

12) ensuring compliance and realization of provisions of international agreements and agreements, legislative and regulations in the field;

13) application and observance of procedures in the limits provided by international standards, filling of the standard documents connected with activities for the prevention and fight against the dope phenomenon in sport;

14) accomplishment of other functions according to the current legislation.

Section 2. Powers and rights of the Agency

8. For the purpose of accomplishment of the main Agency functions performs the following powers:

1) is developed by the project of National anti-doping strategy and provides to the Government for consideration;

2) develops methodological standard rates on the organization and carrying out drug test;

3) represents offers on modification of the national legal system for the purpose of its harmonization with the international standards in the field;

4) is provided by implementation of regulations, imposes the sanctions provided in Section 2 of Chapter VII of the Law No. 185 of July 11, 2012 on prevention of dope in sport and fight against it in case of detection of violations;

5) carries out the tasks following from the international obligations in areas of the activities;

6) develops the relations with civil society for the purpose of acquaintance with activities of the Agency and monitoring of public opinion in this area;
