Agreement between the Ministry of Defence of the Republic of Belarus and Ministry of protection of the region of the Republic of Lithuania on exchange of information on flights of aircrafts

The Ministry of Defence of the Republic of Belarus and the Ministry of protection of the region of the Republic of Lithuania which further are referred to as with the Parties

for the purpose of strengthening and further development of cooperation between Belarus and Lithuania in the field of control of procedure for use of airspace,

realizing the increasing threat of terrorism and danger which it constitutes for the aviation and strategic objects subject to risk of attack from air,

emphasizing the importance of international cooperation in fight against terrorism, and also safety of strategic objects,

admitting the fact that the State company of the Republic of Lithuania "Ignalina nuclear power plant" is especially important strategic object from the point of view of safety at which providing it is necessary to aim all efforts,

for the purpose of ensuring effective exchange of information about flights of aircrafts

signed this agreement as follows:

Article I

For the purposes of this agreement stated below terms mean:

1. "Exchange of information" - exchange of information on the allocated communication channel.

2. "The prohibited area of EY(P)-1/UM(P)-183" - part of airspace over the State company of the Republic of Lithuania "The Ignalina nuclear power plant" within which use of airspace is forbidden.

Parameters of the prohibited area of EY(P)-1/UM(P)-183:

on height - from earth level - 6100 meters;

on the area - circle the radius of 5,4 nautical miles with the center having coordinates: 55 °35'59" northern latitude and 026 °33'53" east longitude.

3. "Aircraft" - the aircraft supported in the atmosphere due to interaction with air, other than interaction with the air reflected from the Earth's surface or water.

4. "Not identified flight" - flight of the aircraft which accessory and the purpose of flight by the performed operations by their determination according to the legislation of the state in whose airspace flight is made, are not established.

5. "Violation of procedure for use of airspace" abuse of regulations and practice of flights which according to the legislation of the state in whose airspace flight is made, belong to violations of procedure for use of airspace.

6. "Central controls":

in the Republic of Belarus - the Central command post of the Air Force and troops of air defense of Armed Forces of the Republic of Belarus;

in the Republic of Lithuania - the Center of control of airspace of the Air Force of the Republic of Lithuania.

Article II

The parties cooperate in the field of exchange of information about flights of aircrafts in the prohibited area of EY(P)-1/UM(P)-183, on the routes conducting to the prohibited area of EY(P)-1/UM(P)-183, and regarding airspace throughout all border between the Republic of Belarus and the Republic of Lithuania fifteen kilometers wide in depth of the territory of the state of each of the Parties for the purpose of strengthening of control of procedure for use of airspace.

Article III

The cooperation between the Parties is performed by exchange of information between central controls about:

a) all flights regarding airspace throughout all border between the Republic of Belarus and the Republic of Lithuania fifteen kilometers wide in depth of the territory of the state of each of the Parties;

b) not identified flights and violations of procedure for use of airspace in the prohibited area of EY(P)-1/UM(P)-183 and on the routes conducting to the prohibited area of EY(P)-1/UM(P)-183, for the purpose of operational identification of the aircrafts breaking procedure for use of airspace.

The parties take all measures established by the legislation of both states for non-admission and suppression of violations of procedure for use of airspace by aircrafts and not identified flights in the prohibited area of EY(P)-1/UM(P)-183, on the routes conducting to the prohibited area of EY(P)-1/UM(P)-183, and regarding airspace, the part of 1 this Article specified in Item (a).

In two-month time after the signature of this agreement of command of the Air Force and troops of air defense of Armed Forces of the Republic of Belarus and the Air Force of the Republic of Lithuania will develop and will approve the Instruction for interaction of central controls which can change and be supplemented in the mutual written consent.

Article IV

For the purpose of accomplishment of provisions of this agreement of the Party establish the direct channel of telephone communication between central controls.

Central controls communicate about all flights regarding airspace, part 1 of article III specified in Item (a).

In case of the detection of the aircraft (courts) which is breaking procedure for use of airspace or carrying out not identified flight in the prohibited area of EY(P)-1/UM(P)-183, on the routes conducting to the prohibited area of EY(P)-1/UM(P)-183, and regarding airspace, part 1 of article III specified in Item (a), central controls without delay inform on this each other.

Article V

The parties independently incur the expenses connected with accomplishment of provisions of this agreement.

Article VI

All disagreements connected with interpretation or application of provisions of this agreement will be settled by the Parties by bilateral consultations and negotiations.

Article VII

This agreement can be changed from written consent of both Parties. Changes and amendments are drawn up by protocols which will be integral part of this agreement, and become effective according to the procedure determined in article VIII.

Article VIII

This agreement becomes effective from the moment of its signing.

This agreement is signed for a period of five years and is automatically prolonged for the subsequent five-year period. The either party can leave this Agreement by the notice in writing of other Party. At the same time the Agreement stops the action after six months from the date of receipt of the written notice.

Signed in Minsk on July 9, 2003 in duplicate in the Russian and Lithuanian languages, and texts in both languages are equally authoritative.
