Based on article 25 of the Law No. 161 of July 22, 2011 on implementation of single window in implementation of business activity (The official monitor of the Republic of Moldova, 2011, Art. No. 170-175, 496) DECIDES: the Government

1. Approve Regulations on creation and functioning of single window on issue of allowing documents in the field of fire safety it (is applied).

2. Appoint the Service of civil protection and emergency situations subordinated to the Ministry of Internal Affairs as the organization responsible for creation and implementation of single window for issue of allowing documents in the field of fire safety.

3. To perform financial covering of creation and functioning of single window on issue of allowing documents in the field of fire safety for the account and within the assignments approved in the budget of Service of the civil protection and emergency situations subordinated to the Ministry of Internal Affairs.

4. To impose control of procedure for accomplishment of provisions of this resolution on the Ministry of Internal Affairs.

Regulations on creation and functioning of single window on issue of allowing documents in the field of fire safety

I. General provisions

1. The regulations on creation and functioning of single window on issue of allowing documents in the field of fire safety (further – the Provision) are developed for simplification and rationalization of the procedure of issue of allowing documents in the field of fire safety, necessary for implementation of business activity (further – allowing documents), the allowing documents established in the List issued by the state bodies issuers to physical persons and legal entities for implementation of business activity, appendix to the Law No. 160 of July 22, 2011 on regulation of business activity by permission.

2. According to Item d provisions) parts (1) Articles 8, Item е) parts (1) article 12 of the Law No. 93 of April 5, 2007 on Service of civil protection and emergency situations and part (1) article 4 of the Law 267-XIII of November 9, 1994 on fire safety, ensuring fire safety in all territory of the country and implementation of the state supervision in the field of fire safety are within the competence of bodies of the state fire supervision as a part of Service of civil protection and emergency situations.

3. The single window on issue of allowing documents in the field of fire safety (further – single window) is the mechanism which allows the applicant to address to the bodies of the state fire supervision consisting of the central body of the state fire supervision (Management of rescuers and firefighters) and local authorities of the state fire supervision (departments and services of fire supervision as a part of managements and departments of emergency situations in municipiums, areas, the cities, sectors) for receipt of allowing documents in the field of fire safety.

4. The mechanism of single window is optional for the applicant and does not interfere with it in receipt of allowing documents in the field of fire safety out of this mechanism.

5. In this Provision allowing documents for which creation of single window is obligatory are:

a) certificate on fire safety of construction materials and constructions;

b) the conclusion about fire safety when implementing some types of activity;

c) the conclusion on the room on production, assembly, storage and/or trade in pyrotechnic products;

d) the conclusion for carrying out in public places of fireworks with use of pyrotechnic products of entertaining purpose of category 4 and/or other pyrotechnic products of category P 2, and also on carrying out in rooms or in the open air pyrotechnic performances with use of pyrotechnic products of scenic purpose of category T2.

6. The employee of single window is employee of body of the state fire supervision which works in single window and carries out the obligations provided by this Provision.

II. The organization of activities of single window for issue of allowing documents in the field of fire safety

7. Activities of single window will be organized as the central body of the state fire supervision (Management of rescuers and firefighters), and local authorities of the state fire supervision (departments and services of the state fire supervision as a part of managements and departments of emergency situations of municipiums, areas, the cities, sectors).

8. Activities of single window are performed according to the working schedule of bodies of the state fire supervision. The schedule affirms annually the order of the chief of Service of civil protection and emergency situations and is available on the official web page of Service of civil protection and emergency situations (www.dse.md), and also on the single government portal of the state services (www.servicii.gov.md).

9. Activities of single window provide:

a) reception of an application about issue of allowing documents;

b) registration and transfer of the statement for issue of allowing documents for consideration;

c) issue of allowing documents.

9. The employee of single window performs the following functions:

Advises 1) and informs the applicant about:

method of giving and consideration of the application about issue of allowing documents;

the procedure and terms of consideration of the application about issue of allowing documents, also about method of application of the principle of acquiescence;

to the procedure of issue of allowing documents;

2) checks correctness of filling of the statement for issue of allowing documents and completeness of the documents enclosed to the application;
