About approval of Rules of the message by the employer on the conclusion of the employment or civil contract on performance of works (rendering services) with the citizen replacing positions of the public or municipal service which list is established by regulatory legal acts of the Russian Federation

According to article 12 of the Federal law "About Anti-corruption" Government of the Russian Federation decides:

1. Approve the enclosed Rules of the message as the employer about the conclusion of the employment or civil contract on performance of works (rendering services) with the citizen replacing positions of the public or municipal service which list is established by regulatory legal acts of the Russian Federation.

2. Declare invalid the order of the Government of the Russian Federation of September 8, 2010 No. 700 "About procedure for the message the employer in case of execution of an employment agreement with the citizen replacing positions of the public or municipal service which list is established by regulatory legal acts of the Russian Federation, within 2 years after its dismissal from the public or municipal service about the conclusion of such agreement to the employer's representative (employer) of the government or local government officer in the last place of its service" (The Russian Federation Code, 2010, No. 37, the Art. 4712).

Rules of the message the employer about the conclusion of the employment or civil contract on performance of works (rendering services) with the citizen replacing positions of the public or municipal service which list is established by regulatory legal acts of the Russian Federation

1. These rules establish procedure for the message the employer about execution of an employment agreement or the civil contract for accomplishment in the organization within a month of works (rendering services to the organization) worth more than 100 thousand rubles with the citizen replacing positions of the public or municipal service which list is established by regulatory legal acts of the Russian Federation (further respectively - the employment contract, the civil agreement, the citizen), to the employer's representative (employer) of the government or local government officer in the last place of its service.

2. The employer in case of execution of an employment agreement or the civil agreement within 2 years after dismissal of the citizen from the public or municipal service reports to the employer's representative (employer) of the government or local government officer in the last place of its service about the conclusion of such agreement in writing.

3. The message is drawn up on the form of the organization and signed by her head or the authorized person which signed the employment contract from the employer or the authorized person which signed the civil agreement. The signature of the employer is certified by seal of the organization or seal of personnel service (in the presence of seals).

4. The message goes to the employer's representative (employer) of the citizen in the last place of its service to 10-day time from the date of execution of an employment agreement or the civil agreement.

5. The message sent by the employer to the employer's representative (employer) of the citizen in the last place of its service shall contain the following data:

a) the surname, name, middle name (in the presence) of the citizen (if the surname, name or middle name changed, are specified former);

b) number, month, year and birthplace of the citizen;

c) the position of the public or municipal service replaced by the citizen just before dismissal from the public or municipal service (according to the data containing in the service record);

d) the name of the organization (complete, and also reduced (in the presence).

6. If the employment contract is signed with the citizen, along with the data specified in Item 5 of these rules the following data are also specified:

a) date and number of the order (order) or other decision of the employer according to whom the citizen is employed;

b) date of execution of an employment agreement and term for which he is imprisoned (start date of work and if the terminal employment contract is signed, - the term of its action is specified);

c) the name of position which is held by the citizen according to the employment contract according to the staff list, and also structural division of the organization (in the presence);

d) the job responsibilities fulfilled on the position held by the citizen (the main directions of the charged work are specified).

7. If the civil agreement is signed with the citizen, along with the data specified in Item 5 of these rules the following data are also specified:

a) date and number of the civil agreement;

b) term of the civil agreement (terms of the beginning and end of performance of works (rendering services);

c) subject of the civil agreement (with the short description of work (service) and its result);

d) cost of works (services) in the civil agreement.
