About approval of Rules of the admission to flights of operators of general aviation

(as amended of the Order of the Government of the Republic of Kazakhstan of 21.05.2013 No. 507)

According to the subitem 22) of article 13 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of the admission to flights of operators of general aviation.

2. This resolution becomes effective from the date of the first official publication.

Rules of the admission to flights of operators of general aviation

1. General provisions

1. These rules of the admission to flights of operators of general aviation (further - Rules) also Appendices 6 (Part II) to the Convention on International civil aviation are developed according to requirements of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (Chicago, 1944).

2. These rules determine procedure for the admission of the physical persons and legal entities operating airplanes with the maximum certified take-off mass less than five thousand seven hundred kilograms and the helicopters irrespective of the maximum certified take-off mass and also operating airplanes with the maximum certified take-off mass over five thousand seven hundred kilograms and (or) the airplanes equipped with one or several turbo-jet (turbo-propeller) engines to accomplishment of general aviation operations.

3. In these rules the following terms and determinations are applied:

1) the applicant - the physical person or legal entity which addressed to authorized body in the field of civil aviation for registration as the operator of general aviation or receipt of the certificate on the right of accomplishment of general aviation operations;

2) the certificate on the right of accomplishment of flights - the document issued by authorized body in the field of civil aviation, certifying compliance to the requirements established by Rules of the admission to flights of operators of general aviation;

3) the operator of general aviation - the physical person or legal entity using the air vehicle for flights for the purpose of general aviation;

4) flight of general aviation - aircraft flight, except commercial air transportation or the flight connected with accomplishment of aerial works;

5) management on production of flights - the document regulating procedure, the organization, providing and accomplishment of flights;

6) the operator's management on maintenance regulation - the document containing the description of procedures of the operator which provide possibility of management of timely and satisfactory accomplishment of all planned and not planned works on maintenance of air vehicles of this operator.

2. The admission to flights of the operators of general aviation operating airplanes with the maximum certified take-off mass less than five thousand seven hundred kilograms and helicopters irrespective of the maximum certified take-off mass

4. The basis for the admission to flights of the operators of general aviation operating airplanes with the maximum certified take-off mass less than five thousand seven hundred kilograms, helicopters irrespective of the maximum certified take-off mass is observance of the following conditions:

1) availability of the existing certificate of the pilot with the admission to management of this aircraft type;

2) availability of the certificate on state registration of the civil air vehicle and the existing airworthiness certificate of the civil air vehicle;

3) ensuring insurance according to requirements of the laws of the Republic of Kazakhstan about obligatory types of insurance;

4) the conclusion of contracts with the aero clubs or non-profit organizations combining operators of air vehicles on provision of services on providing the emergency notification when flying in uncontrollable airspace.

5) For the admission of the operators of general aviation operating airplanes with the maximum certified take-off mass less than five thousand seven hundred kilograms and helicopters irrespective of maximum the certified take-off mass, the applicant sends to authorized body in the field of civil aviation the request according to appendix 1 to these rules with application of documents according to appendix 2 to these rules.

6) the Authorized body in the field of civil aviation within 10 calendar days considers the documents submitted by the applicant. If documents do not conform to requirements of these rules or are provided not in full, the request is subject to return with indication of return reasons in writing.

7) In case of compliance of documents to requirements of these rules the authorized body in the field of civil aviation registers this applicant (owner) of the air vehicle.

8) Accounting of operators (owners) of air vehicles of general aviation is performed by authorized body in the field of civil aviation on electronic and paper carriers.

9) the Owner and the aircraft commander (pilot) ensure aviation safety.
