1. The regulations on transportation of pupils (further – the Provision) establish rules of the organization and implementation of transportations of pupils between the settlement where they live, and general education educational institution in which they study, and also obligations of the service employees involved in course of carriage of pupils.
2. The purpose of this provision is systematization in the single document of safety requirements in transit of pupils.
3. This Provision is supplemented in that measure in which it does not contradict it, provisions of Rules of public conveyance and the baggage road transport approved by the Order of the Government No. 854 of July 28, 2006.
4. Pupils are transported by the buses or minibuses belonging, being under authority or use of local industry authorities in the field of education, bodies of local public authority or educational institution (further – school buses), either buses or minibuses of the carrier agent having the license in the respective sphere based on the agreement according to Item 12.
Transportation of pupils from the settlement of accommodation and from transit settlements in educational institutions and back on the distances exceeding 2 km is performed free of charge.
As origins for calculation of distance are considered: landing place in the settlement of accommodation of the pupil or in the transit settlement and the place of disembarkation (educational institution in which he studies).
5. Main goal of use of school buses is transportation of pupils (in both directions) between the settlement where they live, and general education educational institution in which they study.
6. In addition to the main goal specified in Item 5 of this provision, school buses can be used also in other educational purposes, including for:
1) transportations of pupils in connection with the cultural events and sports meets provided by the schedule of actions of the Ministry of Education and researches / local industry body in the fields of education;
2) transportations of pupils in connection with educational excursions;
3) transportations of pupils in connection with educational school and out-of-school projects;
4) transportations in kindergartens of children from settlements in which there are no preschool institutions;
5) transportations of pupils from the settlement in which they live, in entertaining organization / settlement where in summertime out-of-school events are held;
6) transportations of pedagogical workers in connection with different seminars, conferences, working meetings and other similar actions, provided that thereof the course of carriage of pupils will not be broken;
7) other actions relating to educational process.
7. Transportation of groups of children on all actions specified in Item 6 of this provision will be performed only after its approval by local industry body in the field of education based on the petition of the director of educational institution and after acquaintance of pupils with standards of behavior and safety throughout trip.
8. The petition for approval of transportation of groups of pupils on the actions specified in Item 6 of this provision shall contain the following data:
1) reasons for trip, trip duration;
2) way/rout to follow;
3) number and the participant list (pupils, pedagogical workers, the involved transport drivers);
4) information on funds at the expense of which the expenses connected with trip are provided;
5) the proof of passing by all participants of trip of instructing about rules of conduct and safety throughout trip which shall be signed by each person, irrespective of age;
6) the consent of parents or the guardian to participation of pupils in trip and the certificate of the fact that they examined content of the instructing about rules of conduct and safety which is carried out for pupils.
9. It is forbidden to use the school bus for other types of passenger traffic, including for transportation of persons to the third parties or organizations, and also for simultaneous transportation of pupils and other persons who do not work in educational institution / educational institutions.
10. School buses shall correspond to necessary conditions of comfortableness, and also shall be equipped:
1) equipment for reliability and safety, including brake system;
2) measures of protection on collision case;
3) safety belts with fixture in 3 points for all unprotected places and with fixture in 2 points for all others;
4) the rear-view mirrors excluding "dead" corner;
5) movement interlocking system in case of completely or partially open doors for passengers;
6) the video cameras providing video in inside of the school bus and along the line;
7) the speed limiter (adjusted on the speed of 60 km/h for the new buses acquired after implementation of this provision).
8) the system of global positioning (GPS) or other monitoring system allowing to establish the location of the school bus.
11. For ensuring bigger visibility on the road the school bus is in addition equipped with lighting, the light-reflective alarm system, sound warning systems in case movement is made by back run. Recommended color – nemetalizirovanny yellow. It will be possible to distinguish the vehicle by means of the sign "Children" ("Copii"), identification signs of type of the vehicle, and also lobbies and back light boxes with text "Transportation of children" ("Transport copii").
