About approval of the General regulations on legislative metrology establishing requirements to the bottles used as measuring vessels

According to article 14 of the Law on metrology No. 19/2016 (The official monitor of the Republic of Moldova, 2016, Art. No. 100-105, 190), the Government DECIDES:

1. Approve the General regulations on legislative metrology establishing requirements to the bottles used as measuring vessels it (is applied).

2. To impose control over the implementation of this resolution on economies and infrastructures.

3. This resolution becomes effective after 24 months from the date of publication in the Official monitor of the Republic of Moldova.

The general regulations on legislative metrology establishing requirements to bottles, used as measuring vessels (further – Regulations), state the Directive 75/107/EEC of Council of December 19, 1974 about rapprochement of the legislation of state members concerning the bottles used as measuring vessels published in the Official Magazine of the European Communities of February 15, 1975.

I. General provisions

1. These Regulations are applied to bottles, used as measuring vessels (further – bottles), made of glass or other tough substance assuming similar metrological characteristics, which:

a) are corked (are closed) or designed so that they could be corked (to close), and transportations and supply of liquids are intended for storage;

b) have nominal capacity from 0,05 to 5 l inclusive;

c) have such metrological characteristics (project and production characteristics) that they can be used as measuring vessels in the sense that when they are filled to the specified level or to special quantity proceeding from the maximum capacity of filling, their content can be measured rather precisely.

2. Only the bottles used as measuring vessels which meet the requirements of these Regulations can be marked by the sign provided in the paragraph the second Item 10 of these Regulations.

The bottles used as measuring vessels are subject to legislative metrological control under conditions, the stated Sections in II and III these Regulations.

3. Delivery to the market and use of bottles which conform to the requirements and checkings specified in these Regulations for the reasons concerning their amount, determination of their amount or methods by which they were confided cannot be prohibited or limited.

4. Terms according to the Law No. 647-XIII of November 17, 1995 on metrology, with the subsequent amendments are applied to the correct interpretation of these Regulations:

emptiness of bottle or amount of expansion (further – emptiness) – gap between the theoretical level of filling in case of nominal capacity and the maximum level of filling, and also difference between the maximum capacity of filling and nominal capacity which shall be notable constants for all bottles of the same type, that is for all bottles used in the same purposes;

error, measurement error – difference between the measured value of one size and reference value.

5. The producer, his authorized representative or the importer of the bottles used as measuring vessels shall observe requirements of these Regulations.

II. Specifications for the bottles used as measuring vessels

6. The bottles used as measuring vessels are characterized by the following types of capacity which are determined always at temperature of 20 °C:

a) nominal capacity of Vn is the amount marked on bottle and representing amount of liquid substance which presumably the bottle shall contain if it is filled, on condition of proper use;

b) the maximum capacity represents amount of liquid substance which the bottle contains when filling to the brim (upper edge);

c) the actual capacity represents amount of liquid substance which the bottle contains when filling to the theoretical level corresponding to nominal or maximum capacity.

7. Methods of filling of the bottles used as measuring vessels:

a) filling to permanent level;

b) filling to permanent emptiness.

8. In order that it was possible to measure amount of content of the bottles used as measuring vessels in view of the current uncertainty of filling, with sufficient accuracy and especially, with required accuracy, according to General regulations of legislative metrology on the establishment of rules concerning nominal quantities of the packed-up products approved by the Order of the Government No. 907 of November 4, 2014, the most admissible errors (positive or negative) bottle capacity, that is the greatest permitted differences (positive or negative) under control conditions established in the Section III of these Regulations between the actual capacity and nominal capacity of Vn, shall correspond to the values specified in the following table:

The most admissible error to the maximum capacity of filling is equal to the most admissible error to the corresponding nominal capacity.
