1. Create Public institution "Development of entrepreneurship in agricultural industry" and approve its Charter it (is applied).

2. To public institution "Development of entrepreneurship in agricultural industry" in coordination with the Ministry of Finance of the Republic of Tajikistan and the Ministry of Agriculture of the Republic of Tajikistan to develop and approve structure, the staff list and expense budget on content of Public institution "Development of entrepreneurship in agricultural industry".

3. To the state committee on investments and management of state-owned property of the Republic of Tajikistan and the Ministry of Agriculture of the Republic of Tajikistan according to the procedure, established by the legislation to solve organizationally - legal issues of Public institution "Development of entrepreneurship in agricultural industry".

Charter of Public institution "Development of entrepreneurship in agricultural industry"

Public institution "Development of entrepreneurship in agricultural industry" (further – Organization) as coordination structure directly or by means of the Ministry of Agriculture the Republic of Tajikistan (the executive agency) exercises control and implementation of the industry state investment projects assigned to it according to regulatory legal acts of the Republic of Tajikistan.

- ownership and use of property, being under the right of operational management according to the legislation of the Republic of Tajikistan;

- signing on its own behalf agreements (contracts), implementation of other legal actions, acquisition of rights and implementation of the personal property and non-property rights, capture on obligations, representation in court of interests of Organization;

- independent realization of the current and perspective activities;

- opening of accounts in national and foreign currency in credit institutions of the republic;

- according to the legislation of the Republic of Tajikistan implementation of different types of encouragement of workers;

- implementation of other rights which are not contradicting the purposes and tasks of Organization and the legislation of the Republic of Tajikistan.

9. Obligations of Organization:

- implementation of the activities according to the Constitution and the legislation of the Republic of Tajikistan, legal acts, recognized as Tajikistan and ensuring fulfillment of requirements of this Charter;

- in coordination with the executive agency ensuring projects implementation according to the approved project documents and conditions of signed agreements;

- providing to the employees of safe working conditions;

- development and implementation operational and financial accountings of financial and economic activities, statistical and accounting documents;

- application of financial resources according to the approved project documents and conditions of signed agreements;

- provision of information and the report on the activities, the state projects connected with the course of realization according to established procedure to the Government of the Republic of Tajikistan, the relevant ministries and departments, and the financing partners in development;

- accomplishment of other obligations following from the legislation.

5. Sources of formation of means and property

10. The organization has the building, constructions, the equipment and other property necessary for ensuring the activities provided by this Charter.

11. Means of Organization are formed of the following sources:

- the grants provided by International Development Association, the World Bank and other partners in development for projects implementation;

- the additional loans and grants allocated by partners in development on for projects implementation;
