About accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014
The Republic of Belarus, the Republic of Kazakhstan and the Russian Federation, on the one hand, and the Kyrgyz Republic, on the other hand, further referred to as with the Parties,
confirming the friendship connecting the Parties both their people, and aspiration to provide their prosperity
performed determination to give new impulse to development of closer integration, rapprochement of economies of the Parties for the purpose of social progress and improvement of welfare of the people,
confirming the interest in development of Eurasian integration process,
being guided by statements of heads of the Republic of Belarus, the Republic of Kazakhstan, the Russian Federation and the Kyrgyz Republic of May 29, 2014 and on October 10, 2014 about participation of the Kyrgyz Republic in Eurasian integration process,
in view of signing on October 10, 2014 Treaties of Accession of the Republic of Armenia to the Agreement on the Eurasian Economic Union of the May 29, 2014 providing including introduction of amendments to the Agreement on the Eurasian Economic Union of May 29, 2014,
taking into account that the international agreements based on which forming of the contractual legal base of the Customs union and the Common economic space was performed became basis of the Agreement on the Eurasian Economic Union of May 29, 2014, stating readiness of the Kyrgyz Republic for accomplishment of the obligations provided by the specified international treaties, considering work progress on accomplishment by the Kyrgyz Republic of necessary actions for accession of the Kyrgyz Republic to the Customs union and the Common economic space of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation,
agreed as follows:
This Agreement the Kyrgyz Republic joins the Agreement on the Eurasian Economic Union of May 29, 2014, and also to other international treaties entering the right of the Eurasian Economic Union according to the list according to appendix to this Agreement and from the effective date this agreement and protocols specified in paragraphs second and third this Article becomes the member of the Eurasian Economic Union.
Due to the accession of the Kyrgyz Republic in the Agreement on the Eurasian Economic Union of May 29, 2014 and in the separate international agreements specified in appendix to this Agreement (taking into account the changes made by the Protocol on introduction of amendments to the Agreement on the Eurasian Economic Union of May 29, 2014 and the international agreements signed within forming of the contractual legal base of the Customs union and the Common economic space in connection with accession of the Republic of Armenia (appendix No. 2 to the Treaty of Accession of the Republic of Armenia to the Agreement on the Eurasian Economic Union of May 29, 2014 signed on October 10, 2014)), changes according to the separate protocol which will be integral part of this Agreement are made.
Application by the Kyrgyz Republic of separate regulations of the Agreement on the Eurasian Economic Union of May 29, 2014 and other international treaties specified in appendix to this Agreement is performed in accordance with the terms and the transitional provisions determined by the separate protocol which will be integral part of this Agreement, and taking into account arrangements on application of the Common customs tariff of the Eurasian Economic Union concerning goods according to the list provided by this protocol.
If before entry into force of this Agreement it will be signed or the international treaty concluded between state members of the Eurasian Economic Union on the questions connected with functioning and development of the Eurasian Economic Union entering the right of the Eurasian Economic Union not specified in appendix to this Agreement will become effective, the Kyrgyz Republic assumes liabilities on accession to such international treaty for date of its entry into force according to the separate protocol, but not earlier than the date of entry into force of this Agreement.
From the date of the introduction of this Agreement in force the Kyrgyz Republic applies the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union.
Application by the Kyrgyz Republic of the Common customs tariff of the Eurasian Economic Union is performed from acceptance date by the Supreme Eurasian economic council of the decision on cancellation of customs control of the goods and vehicles moved through the Kyrgyz-Kazakhstan site of frontier taking into account the provisions determined by the protocol specified in paragraph three of Article 1 of this Agreement.
From the date of the introduction of this Agreement in force acts of bodies of the Eurasian Economic Union, and also the decision of the Supreme Eurasian economic council (Interstate Council of Eurasian economic community (The Supreme body of the Customs union)), decisions of the Eurasian economic commission (The commissions of the Customs union) operating for date of the introduction of this Agreement in force are subject to application in the territory of the Kyrgyz Republic taking into account the provisions determined by the protocol specified in paragraph three of Article 1 of this Agreement and taking into account paragraph two of Article 3 of this Agreement.
Provisions on settlement, connected with membership of the Kyrgyz Republic in the World Trade Organization, are determined by the protocol specified in paragraph three of Article 1 of this Agreement.
For the purpose of observance of single trade regime of the Eurasian Economic Union the Kyrgyz Republic applies to the third countries in trade with the third countries the mode corresponding to the mode applied by all state members of the Eurasian Economic Union as of January 1, 2015 according to the international treaties signed by them with such third countries.
The decision on cancellation of customs control of the goods and vehicles moved through the Kyrgyz-Kazakhstan site of frontier is accepted by the Supreme Eurasian economic council.
The supreme Eurasian economic council will consider question of the decision making specified in paragraph one of this Article no later than May 8, 2015 taking into account assessment of system of customs control after accomplishment of the following events:
