The State Customs Committee of the Republic of Belarus and Customs department of the Republic of Moldova which are hereinafter referred to as by the Parties

aiming to exercise more effective customs control over movement of goods, passengers and vehicles between the Republic of Belarus and the Republic of Moldova,

recognizing that timely exchange of information, and also mutual aid and cooperation of the Parties will promote enhancement of customs control,

for the purpose of implementation of the Agreement on cooperation and mutual assistance in customs affairs of April 15, 1994 (further - the Agreement)

agreed as follows:

Article 1

Measures for coordination of customs control and exchange of information are performed by the Parties within their competence and according to the legislation of the states of the Parties.

Article 2

The parties determine the relevant structural divisions of the central offices providing settlement, connected with implementation of the Agreement and authorize them to perform direct contacts.

Article 3

The parties give to the relevant customs authorities authority on establishment and maintenance of direct connections, within their competence, concerning the organization of customs control, to the operational questions requiring the immediate solution and also for the purpose of exchange of information.

The customs authorities specified in part one of this Article will inform the central bodies on results of meetings at the local level, and also on content of the taken place exchange of information.

Article 4

The parties will exchange lists of persons authorized for implementation of direct contacts within 30 days after signing of the this Protocol.

Article 5

The parties provide each other information according to Articles 4, of 5, of 6, 7 Agreements the concerned party could take necessary measures for ensuring proper observance of the customs legislation timely.

In view of urgency information transfer in oral form will be allowed, however it shall be confirmed without delay in writing.

Article 6

The parties within their competence and powers will aim at acceptance of necessary measures for accomplishment of the inquiries sent Articles 4, of 6, 12 Agreements.

If necessary the copies of documents attached to reply to the request will be certified by the Parties as appropriate.

Article 7

Agents of the parties will meet at least once a year for discussion of questions concerning implementation of the Agreement and the this Protocol.

Article 8

The parties will create the standing Belarusian-Moldavian working group on customs questions for coordination of work on implementation of the Agreement and the this Protocol, and also discussion of other customs questions which are of mutual interest.

Article 9

The parties will charge them to relevant organs to carry out among themselves as required working meetings on the current questions entering their competence.

Article 10

The disputes and disagreements arising in connection with interpretation and application of the this Protocol are solved by negotiations and consultations between the Parties.

Article 11

By mutual consent of the Parties in the this Protocol changes and additions which are drawn up by the separate protocols which are its integral part can be made and become effective according to article 12 of the this Protocol.

Article 12

The this Protocol becomes effective after 30 days after signing and the Agreement voids on the same day, as.

It is made in Chisinau on April 6, 2004 in duplicate, everyone in the Russian and Moldavian languages, and both texts are equally authoritative.
