1. Approve the enclosed Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil.

2. To provide to department of waste management of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in mass media and information system of law "Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil

1. General provisions

1. Rules of maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil (further - Rules) are developed according to the subitem 2) of article 25 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use", the Ecological code of the Republic of Kazakhstan and determines procedure for maintaining the state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil.

2. These rules are obligatory for the users of nature having subjects to burial of hazardous substances, radioactive waste and dumping of sewage into subsoil in the territory of the Republic of Kazakhstan.

3. The state inventory of burials of hazardous substances, radioactive waste and dumping of sewage into subsoil (further - the State inventory of burials) contains the data characterizing type and type of the buried substances and the dumped waters with indication of their quantitative and qualitative indexes, mining, special engineering-geological, hydrogeological and ecological conditions of burial and dumping and includes:

1) general characteristic of subjects to burial of hazardous substances, radioactive waste and places of dumping of sewage: location, period of operation, charge, availability and arrangement of the supervisory network of monitoring of state of environment and monitoring of subsoil;

2) physical characteristic of subjects to burial of hazardous substances, radioactive waste and places of dumping of sewage: the characteristic of isolation, type of rocks, depth and effective capacity of layer collector, its area, porosity coefficient, the characteristic of the spreading and blocking water emphasis, speed of natural flow of underground waters, dumping storage both other quantitative and qualitative indexes;

3) characteristic of hazardous substances, radioactive waste, sewage: the name of product, technological production or process as a result of which the product, physical characteristic (complete chemical composition, content of toxic components, fire-and-explosion hazard, solubility, compatibility with other substances is formed in case of storage, the main contaminating radionuclides, their activity and other characteristics), the characteristic of transportation system.

2. Procedure for maintaining the State inventory of burials

The state inventory of burials will organize authorized body in the field of environmental protection (further - authorized body) for the purpose of operational receipt of information, decision making in the field of environmental protection, planned control of condition of places of burial of hazardous substances, radioactive waste and dumping of sewage into subsoil.

5. Are provided with authorized body when maintaining the State inventory of burials:

1) control of timely receipt of data from users of nature;

2) collection, accounting, systematization and storage of materials;

3) creation and functioning of the automated system of data processing with use of computer facilities for the purpose of reference servicing of users of nature;

4) correctness of execution of the State inventory of burials.

6. The State inventory of burials subjects to burial of hazardous substances, radioactive waste and the place of dumping of sewage into subsoil are subject to accounting.

7. The authorized body on the basis of the data which arrived from users of nature constitutes the State inventory of burials.

8. The users of nature having burials of hazardous substances, radioactive waste and performing dumping of sewage into subsoil annually as of January 1 during the first quarter of the year following reporting represent to authorized body of the data in duplicate, drawn up in form according to appendix to these rules.

In case of discrepancy of the provided data to requirements of these rules, they within five calendar days from the date of their receipt to authorized body return to the user of nature to completion in time, not exceeding ten calendar days from the date of refusal in registration.
