AGREEMENT

About friendship, mutual understanding and cooperation between the Kyrgyz Republic and Turkmenistan

The Kyrgyz Republic and Turkmenistan which further are referred to as with High contracting parties

proceeding from the developed traditions between our people, mutual understanding and respect,

the full of determination to build the interstate relations on the principles of equality, justice and mutual understanding,

being guided by aspiration to development of equal, mutually beneficial and full cooperation,

confirming the commitment to the purposes and the principles of Articles of organization of the United Nations, to the conventional principles and rules of international law,

agreed as follows:

Article 1.

High contracting parties shall develop among themselves cooperation on the basis of mutual trust and respect and taking into account mutual interests.

High contracting parties will promote strengthening of mutual understanding and friendship between the people of both states.

Article 2.

High contracting parties make all efforts for ensuring the international security, conflict prevention and providing priority of the conventional principles and rules of international law in the relations between the states.

Article 3.

Each of High contracting parties guarantees to the citizens of other High contracting party living in its territory irrespective of their nationality, origin, the relation to religion or other distinctions, the civil, political, social, economic and cultural laws and freedoms according to the legislation and international treaties which participants are High contracting parties.

Each of High contracting parties recognizes the right of other High contracting party to protect the rights of the citizens living in the territory of other High contracting party to give them support according to the conventional principles and rules of international law, and also according to the legislation of each of High contracting parties.

Article 4.

High contracting parties hold consultations at appropriate levels for the purpose of exchange of opinions, consideration and the solution of questions of the bilateral relations and discussion of the international problems which are of mutual interest.

High contracting parties aim whenever possible at the most complete rapprochement of the line items in these areas and, if necessary, carry out collateral or coordinated actions.

For this purpose, under approval of High contracting parties, summits and consultations at the different level are held.

Article 5.

Each of High contracting parties abstains from participation or support of any actions causing damage to sovereignty, independence and territorial integrity of other High contracting party.

Any of High contracting parties does not allow use of the territory by other states or groups of persons to the detriment of safety of other High contracting party.

In case of situation which, according to one of High contracting parties, affects its safety or creates threat to international peace and safety High contracting parties without delay hold consultations with the purpose of consideration and settlement of the current situation.

Article 6.

High contracting parties interact in the UN and other international organizations, including the economic, financial organizations.

High contracting parties assist further development of cooperation within the international organizations which members they are, first of all in the United Nations for the purpose of the most complete rapprochement of the line items when it is obviously necessary, and ensuring the most effective implementation of the measures taken within these organizations.

Article 7.

High contracting parties develop and strengthen bilateral mutually beneficial cooperation in the military and technical sphere according to the legislation and taking into account the assumed international obligations.

Article 8.

According to the national legal system and without damage concerning the rights and obligations following from the international obligations, High contracting parties will make efforts for development and strengthening of cooperation in all areas which can be of to them mutual interest and benefit.

The cooperation will be performed, in particular, but without being limited, in the following areas:

a) agricultural industry;

b) oil, gas and mineral resources;

c) power and energy resources;

d) transport and telecommunications;

e) sport and tourism;

e) technologies and innovations;

g) trade, culture and education.

Article 9.

High contracting parties develop equal and mutually beneficial cooperation in the field of the trade, economic and scientific and technical relations.

High contracting parties take adequate measures for development and enhancement of bilateral trade and economic relations, taking into account the existing international practice.

In trade and economic relations High contracting parties do not apply discriminatory measures on the relation to each other.

High contracting parties abstain from actions which could cause economic damage to other High contracting party, and beforehand inform on economic decisions which can affect the rights and legitimate interests of other High contracting party.

High contracting parties will provide favorable conditions for development of economic and trade relations between subjects of economic activity of different patterns of ownership of both states according to their national legal system.

Article 10.

High contracting parties on regular basis will communicate on the questions which are of mutual interest.

Article 11.

High contracting parties help cooperation between parliaments of both states.

Article 12.

High contracting parties develop and deepen cooperation in the fields of education, health cares, cultures, science and technology.

Each of High contracting parties promotes acquaintance of the population with scientific, technical and cultural achievements of other High contracting party.

High contracting parties make efforts for giving to all interested persons opportunity to learn language, culture, literature and history of other High contracting party.

For the purpose of ensuring the best mutual understanding between the people High contracting parties develop cooperation in the field of mass media.

High contracting parties promote development on regular basis of joint programs in the fields of education, cultures, science and technology in which are determined with the assistance of competent authorities of High contracting parties of condition of implementation in practice of their cooperation.
