About temporary measures for ensuring execution of supervising functions in the field of power and construction

For the purpose of enhancement of the mechanism of implementation of activities for control and supervision in the field of ecological and technical safety, being guided by articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Temporarily, before legislative settlement to determine that:

- the energy companies make assignments on financing of activities of authorized state body for control and supervision in the field of ecological and technical safety depending on amount of the conventional technical units approved in accordance with the established procedure;

- the construction organizations make assignments in the amount of, not exceeding covering of expenses on carrying out the state architectural and construction supervision, agrees to the calculation of assignments for implementation of the state architectural and construction supervision approved by this resolution.

2. To the Ministry of Energy and Industry of the Kyrgyz Republic to provide in electricity tariffs, heat power and gas of funds for financing of activities of authorized state body for control and supervision in the field of ecological and technical safety.

3. Approve the enclosed calculation of assignments for implementation of the state architectural and construction supervision.

4. Determine that the state architectural and construction supervision of the social objects financed from the budget of the state organizations, organizations and companies is performed without assignments on its carrying out.

5. The state inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic for the purpose of enhancement of the regulatory legal base in spheres of the power and architectural and construction activities regulating conducting inspection and supervision till November 10, 2014 to develop and submit the corresponding projects of regulatory legal acts for consideration of the Government of the Kyrgyz Republic.

6. Bring in the order of the Government of the Kyrgyz Republic "About special means and the deposit amounts of the organizations consisting on the government budget of the Kyrgyz Republic" of August 28, 2000 No. 531 the following amendment:

The list of the special means which are not subject to withdrawal in the income of the republican budget approved by the above-stated resolution:

- add with Item 43 following of content:

"43. The means deducted by the power companies and customers of objects of town planning and architecture.".

7. Bring in the order of the Government of the Kyrgyz Republic "About the Special account of development and material security of the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic" of May 14, 2012 No. 291 the following amendment:

in Regulations on the Special account of development and material security of the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic approved by the above-stated resolution:

- add Item 3 with the paragraph third the following content:

"-ensuring efficiency of implementation of control and supervising functions.".

8. Recognize invalid:

- Item 3 of the order of the Government of the Kyrgyz Republic "About the Special account of development and material security of the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic" of May 14, 2012 No. 291;

- the paragraph third Item 3 of the order of the Government of the Kyrgyz Republic "About entering of amendments and changes into the order of the Government of the Kyrgyz Republic of February 10, 2009 No. 95 "About approval of the Regulations on classification of characteristics of construction objects and procedure for carrying out the state architectural and construction supervision of construction objects, reconstruction and other changes of real estate objects in the Kyrgyz Republic" of October 12, 2009 No. 638.

9. To impose control of execution of this resolution on department of regional development, transport, construction and communications of Government office of the Kyrgyz Republic.

10. This resolution becomes effective since July 1, 2014 and is effective till April 1, 2015.

11. Publish this resolution in mass media.
