About approval of the Regulations on investigation and accounting of labor accidents and other damages of health of the workers connected with execution of labor obligations by them

In pursuance of the Law of the Republic of Uzbekistan "About labor protection", the Labor code of the Republic of Uzbekistan and for the purpose of establishment in the territory of the republic of single procedure for investigation and accounting of accidents and other damages of health of the workers who occurred in connection with labor activity at the companies, organizations, the organizations of all patterns of ownership and also at certain citizens under the labor contract, the Cabinet of Ministers decides:

1. Approve Regulations on investigation and accounting of labor accidents and other damages of health of the workers connected with execution of labor obligations by them according to appendix.

2. To the ministries, departments, corporations, associations, concerns to bring the specified Provision to the companies and the organizations, to provide its studying and strict accomplishment.

3. Enact Regulations on investigation and accounting of accidents and other damages of health of workers on production since July 1, 1997.

4. To the Ministry of Health of the Republic of Uzbekistan to develop the stipulated in Item 1 Section III of Provisions on investigation and accounting of accidents and other damages of health of workers on production the scheme of determination of severity of damages to result of labor accidents in a month.

5. Consider since July 1, 1997 invalid the Regulations on investigation and accounting of labor accidents approved by the resolution of the All-Union Central Council of Trade Unions and Gospromatomnadzor of the USSR of August 17, 1989 No. 8-12.

Regulations on investigation and accounting of labor accidents and other damages of health of the workers connected with execution of labor obligations by them

I. General provisions

1. This Provision establishes single procedure for investigation and accounting of accidents and other damages of health of the workers who occurred in connection with labor activity at the companies, organizations, the organizations of all patterns of ownership and also at certain citizens under the labor contract for the territories of the Republic of Uzbekistan.

This Provision also extends on:

the citizens serving sentence according to the court verdict during work on production;

employers;

persons, in contract and to orders, performing works on civil contracts;

the citizens participating in liquidation of emergency situations of natural and technogenic nature;

the foreign citizens working on hiring if other is not provided by the special international agreement;

the military personnel including passing alternative service, directed to the companies for accomplishment of the construction, agricultural and other works which are not connected with passing of military service;

students and pupils when passing work practice at the company.

Note. The accidents with pupils and students which happened during teaching and educational process are investigated and considered according to the procedure, established by the Ministry of national education, the Ministry of the higher and secondary vocational education, the Center of secondary vocational, professional education of the Ministry of the higher and secondary vocational education in coordination with the Ministry of Labour and Social Protection of the population.

2. The following accidents are subject to investigation and accounting:

injuries, poisonings, heatstrokes, explosions, accidents, destructions of buildings, constructions and designs, burns, frostbites, drownings, defeats with current and lightning, damages to result of contact with animals, insects and reptiles, acts of terrorism, and also other damages of health in case of natural disasters (earthquakes, landslides, floods, hurricanes, etc.) which happened in case of accomplishment of labor obligations (and also in business trips) in the territory of the company and beyond its limits;

when making any actions for the benefit of the company, though without order of the employer, on accomplishment of the functional obligations, and also for the purpose of accident prevention, death of people and preserving property of the company;

in case of the road accident, on rail, air, sea and river transport, the electric transport - in the time spent of the worker in business trip or accomplishment of the functional obligations by it;
