1. Approve Regulations on use of the national sign "Agricultura Ecologica-Republica Moldova" it (is applied).

2. To impose control over the implementation of this Resolution on the Ministry of Agriculture, regional development and the environment.

Regulations on use of the national sign "Agricultura Ecologica-Republica Moldova"

I. General provisions

1. The regulations on use of the national sign "Agricultura Ecologica-Republica Moldova" (further – the Provision) are developed according to Item b) parts (2) Article 4 and article 6-1 of the Law on ecological farm-production No. 115-XVI of June 9, 2005 and establishes procedures of providing the right to use the specified national sign and procedure for marking of ecological agricultural products by it.

2. According to the provisions provided by the Law No. 115-XVI of June 9, 2005 the national sign "Agricultura Ecologica-Republica Moldova" is applied to the ecological agricultural products which underwent the procedure of inspection and certification.

The national sign "Agricultura Ecologica-Republica Moldova" is official sign, confirmatory that the production process is controlled by bodies for inspection and certification and guarantees that the product is received according to requirements and the principles of ecological farm-production.

3. The basic concepts used in this Provision mean the following:

1) not processed products – the products received from raw materials of plant or animal origin which were not subjected to technical conversion, unpacked, intended for conversion or direct consumption;

2) the processed products – the products received as a result of technical processing, cutting, crushing, mixing, packed into reservoirs from metal, the glasses, natural or made-up casing labeled and marked.

4. During the labeling or promotion of the raw or processed products of ecological agricultural products the business entities acting in the field of ecological products are guided by requirements of the Law on ecological farm-production No. 115-XVI of June 9, 2005, the Law on foodstuff No. 78-XV of March 18, 2004, the Law No. 279/2017 on informing consumers concerning foodstuff, and the Technical regulation "Ecological Farm-production and Labelling of Ecological Agricultural Products" approved by the Order of the Government No. 1078 of September 22, 2008.

5. The national sign "Agricultura Ecologica-Republica Moldova" is property of the state, is registered by the State agency on intellectual property (AGEPI) and is controlled the Ministry of Agriculture, regional development and the environment.

6. According to requirements of part (3) article 7 of the Law on ecological farm-production No. 115-XVI of June 9, 2005 business entities are producers and processors of ecological agricultural products shall use in case of realization of ecological agricultural products the national sign "Agricultura Ecologica-Republica Moldova" in order to avoid introduction of consumers in delusion. The combination of the text and graphical representation "Agricultura Ecologica – Republica Moldova" is used only as national sign on condition of strict observance of provisions of the specified Law.

7. The right to use the national sign "Agricultura Ecologica-Republica Moldova" is granted to free of charge business entities who make, overwork, export and/or sell ecological agricultural products and are registered by competent authority, for the purpose of providing to consumers guarantee that the product on which the national sign is applied is received according to provisions of the Law No. 115-XVI of June 9, 2005 and the Technical regulation "Ecological Farm-production and Labelling of Ecological Agricultural Products" approved by the Order of the Government No. 1078 of September 22, 2008.

II. The elements constituting the national sign "Agricultura Ecologica-Republica Moldova"

8. The national sign "Agricultura Ecologica-Republica Moldova" (the drawing 1) consists of three elements:

- the element 1 – represents sign symbol - the stylized image of leaf which color changes from light shades to more dark;

- the element 2 – in the center of the sheet on white background is located the eco logo of bright green color;

- the element 3 – on perimeter of all leaf is located text "Agricultura Ecologica – Republica Moldova";

9. All elements of the national sign "Agricultura Ecologica-Republica Moldova" shall be accurate and well visible.

10. The elements forming the national sign "Agricultura Ecologica-Republica Moldova" are inseparable.

III. Marking of ecological agricultural products

11. The national sign "Agricultura Ecologica-Republica Moldova" shall be located so that it could be found easily.

12. For the processed products the national sign "Agricultura Ecologica-Republica Moldova" is applied on the label on front and the back of packaging.

13. For not processed products the national sign "Agricultura Ecologica-Republica Moldova" is placed on the face of packaging, box, etc.
