1. Approve the enclosed Rules of ceiling determination of price for retail sale of oil products on which state regulation of the prices is established.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in mass media and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Rules of ceiling determination of price for retail sale of oil products on which state regulation of the prices is established

1. These rules of ceiling determination of price for retail sale of oil products on which state regulation of the prices is established (further - Rules) are developed according to subitem 21-3) of article 7 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products" (further - the Law) and establish procedure for ceiling determination of price for retail sale of oil products on which state regulation of the prices is established.

2. In these rules the following basic concepts are used:

1) barrelization coefficient - coefficient of transfer of units of measure from barrel in metric ton taking into account the actual density and temperature of extracted crude oil specified to standard conditions of measurement;

2) world oil price - the average quotation of the price in foreign currency of standard grade "Dated Brent" (Brent Dtd) for the corresponding period based on the source of information included in the List officially acknowledged sources of information on market prices approved by the order of the Government of the Republic of Kazakhstan of March 12, 2009 No. 292 (further - the List).

Other concepts and terms used in Rules are applied according to the legislation of the Republic of Kazakhstan.

3. Ceiling price for retail sale of oil products on which state regulation of the prices is established is determined on the basis of the table of ceiling values of price for retail sale of oil products depending on world oil price (further - the Table) which is developed by authorized body in the field of production of oil products (further - authorized body) in form according to appendix to these rules, on the basis of the following formula:

1) P - marginal value of retail price of the corresponding type of oil product;

2) _PBr - the quotation of world oil price translated on barrelization coefficient;

3) L - coefficient of transfer of the quotation of oil price in the quotation of the price of the corresponding type of oil product which developed in two calendar years prior to the period of calculation of coefficient which is calculated by the following formula:

_PNp - the quotation of the world price for oil product corresponding to oil product on which state regulation of the prices based on the source of information included in the List is established;

_PBr - the quotation of world oil price translated on barrelization coefficient;

4) _TCEx? - conditional average value of transportation expenses on delivery of oil products from the markets of Europe (FOB Italy) to border of the Republic of Kazakhstan including the freight (the freight charge of oil products the sea tanker from the port of Novorossiysk to the Mediterranean FOB Italy Augustus), expenses on transfer (the cost of discharge of oil products from cistern cars, filling in reservoirs of storage in port and filling from storage in the tanker), railway transportation to border of the Republic of Kazakhstan (the cost of railway transportation from the port of Novorossiysk to border of the Republic of Kazakhstan);

5) ECD - value of the export customs duty on the corresponding type of oil product calculated by formula according to Rules of calculation of the size of rates of the export customs duties on crude oil and the goods developed from oil, approved by the order of the Minister of national economy of the Republic of Kazakhstan of February 17, 2016 No. 81 (it is registered in the Register of state registration of regulatory legal acts for No. 13217);

6) With - US dollar exchange rate to tenge at the rate of National Bank of the Republic of Kazakhstan;

7) T - excise on the corresponding type of oil product and the value added tax approved according to the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)";

8) _TCDom - average arithmetic value of the freight charge of oil products by rail across the Republic of Kazakhstan;

9) S - expenses on storage of oil products on the petroleum storage depot in the amount of 3%;

10) _Opex - the amount of operating expenses of all participants of the market of oil products in the amount of 10%;

11) M - margin of all participants of the market of oil products in the amount of 15%;

12) _Ki - the coefficient determined according to item 4 of these rules;
